Practical Exploration Of Conditional Non-Prosecution Of Juvenile Nursing And Teaching Cases

In 2013,China’s newly revised "Special Procedure of Criminal Procedure Law" set up special chapters to regulate the relevant litigation system of juveniles involved in crimes,and promulgated conditional non-prosecution and guardianship and education system with juveniles not being prosecuted as the main object of application.Aiming at "care,education and resettlement",the system focuses on the lack of growth guardianship and continuous follow-up of young people who have not been inspected.Specifically,social work organizations with various judicial backgrounds and social forces make rational use of relevant social resources,professional concepts and skills,and carry out personalized and professional nursing and teaching for the undetected teenagers,so as to promote their smooth return to society,and carry out activities with both judicial and social characteristics.After six years of implementation,an advanced model of watching and helping education,represented by Beishengguang,has been formed.At the same time,when the system is applied everywhere,it also shows that the additional conditions are not operable,the content of implementation is not clearly regulated,and the executing subject has greater autonomy.This article mainly takes Lanzhou X Procuratorate as an example to explain the practice of the conditional non-prosecution case of the undetected youth.The first part mainly explains the relevant concepts of the conditional non-prosecution system for the undetected youth and the case of nursing and teaching.The research object of this paper is the practical process of the case of nursing and teaching,and the object of nursing and teaching is the undetected teenagers who have been subjected to a conditional non-prosecution decision by the procuratorial organ to conduct minor criminal acts objectively.The second part,mainly for Beijing and Shanghai area,the good operation mode and practice of the nursing and teaching system are compared.Generally speaking,Beijing’s nursing and education belongs to the government-led-judicial social worker-led type,which tends to take joint action by various departments and make rational use of social forces and related resources;Shanghai’s nursing and education pays attention to the "professional model-social assistance and education",preferring to transfer the nursing and education to social forces.The third part is mainly to analyze the social investigation and case-basednursing and teaching process of the undetected teenagers entrusted by X Procuratorate.It is mainly divided into the following aspects: social investigation,attribution analysis of social investigation problems,design of nursing and teaching programs,practice of nursing and teaching,and evaluation of case closure.The fourth part is the reflection and improvement strategy in the practice of case-based nursing and teaching.It puts forward some exploratory suggestions on the development of case-based nursing and teaching for minors in Lanzhou from two aspects.
