In most developed countries and regions,the Family Tribunal has set up judges who specialize in family trials,and has introduced social workers and other personnel who have a certain professional skill in family mediation to coordinate and manage family affairs,as well as form a system suitable for family cases.specialized civil litigation procedures to comprehensively and systematically handle marriage and family matters.In the current family court trials,the number of cases shows an increasing trend.In the relevant government guidance documents,it is also proposed to study and introduce various methods such as family investigators,family social workers and child psychologists,and actively participate in all aspects of family mediation.Improve the level of judicial services and social security in family trials.Through reading the data,the family mediation system in Taiwan is relatively complete.The regulations on family mediation are: when some conflict occurs in the family,it must be resolved in accordance with the legal approach of civil litigation,whether it is a major family case such as husband and wife,parent-child or inheritance,etc.,In order to assist the parties to deal with internal differences through mechanisms other than litigation procedures,and to reconstruct or adjust harmonious family identities and property relations between them,a system of civil litigation mediation first is implemented.The court will invite a team of social workers,persons with years of psychological counseling work experience or psychological counseling learning background,or persons with years of family dispute mediation and consulting experience to help the parties to the dispute how to calmly think about the problems they face and agree on a The most reasonable and feasible solution to the problem.By understanding the reform of the family tribunal of the Jing’an District People’s Court in Shanghai,this paper focuses on the comparison of the judicial social worker’s participation in family mediation in the family court in Taiwan.This article is divided into four parts.The first part briefly introduces the development of judicial social workers in Shanghai and Taiwan as family mediators.The second part mainly introduces the service status of judicial social workers as family mediators,the family court(court)’s quality requirements for judicial social workers as family mediators,and the support system for judicial social workers as family mediators.The third part compares the situation of judicial social workers serving as family mediators in Shanghai and Taiwan.In addition to paying attention to the interests of minors and focusing on similar concepts of problem solving,it focuses on the focus of mediation work,family mediation and family mediation.This paper compares the ways of selecting and appointing members,the legal basis for judicial social workers to serve as mediators,and the growth path of judicial social workers to serve as family mediators.The fourth part is the summary part,which writes Taiwan’s enlightenment to the judicial social workers involved in family case mediation in the mainland.Suggestions are made on the growth channels of social workers and broadening the service areas of judicial social workers in the trial of family cases.Based on social work,this article explores the advanced experience worth learning from Taiwan,in order to promote the development of social work intervention in family mediation and explore the establishment of social work intervention.The related system of family case mediation contributes to the healthy development of the reform of the family trial system.
