Research On The Perfection Of Fair Competition Review System

With the development of China's economy,China's economic policy dominated by industrial policy gradually inclines to dominated by competition policy,and China's fair competition review system has been established on this background.The fair competition review system is of great significance to the improvement of China's market economy.Specifically,this paper is divided into four parts:The first part elaborates the theoretical basis of establishing fair competition review system in China.The fair competition review system can clarify the boundary between the government and the market,and make up for the shortcomings of "ex post review" in antitrust law enforcement.The second part elaborates the current situation and shortcomings of the fair competition review system initially established in China.The fair competition review procedure is initially clear,and the review criteria are gradually refined.However,the review criteria are currently fixed at the qualitative analysis level,and need to be further developed to the quantitative analysis level in order to meet the diversification requirements of market development.The third part elaborates the different types of practice and experience of fair competition review system in foreign countries to provide reference for our country.Mainly divided into external review mode and internal review mode,our country currently adopts internal review mode.The fourth part elaborates the suggestions for the improvement of fair competition review system in China,mainly from three aspects:exploring the method of encouraging policy makers to make appropriate evaluation;further improving the reference standard of periodic evaluation in fair competition review;and further explaining the standard of proof and judgment in the exception provisions.
