Research On The Improvement Of The Fair Competition Review System

The fair competition review system is an ex ante method to regulate the government’s administrative monopoly.It is undoubtedly of great significance for building a competition-friendly government and coordinating competition policies and industrial policies.The current fair competition review system still has shortcomings.In terms of review methods,self-review methods have encountered the dilemma of policy-making agencies’ lack of review willingness and ability;review objects fail to treat stock policies and incremental policies equally;exceptions The regulations lack refinement;the guarantee mechanism is not perfect enough to make it difficult for the fair competition review system to give full play to its effectiveness;the current implementation basis for the system also has the problem of low levels.This makes it difficult for the fair competition review system to truly exert its effect.The OECD organization actively advocates the establishment of a competition evaluation system.The European Union,the United States,Japan and other countries have established their own competition evaluation systems based on their own realities.There are many things that are worth learning from,such as the EU’s national aid control system and Australia’s competition payment system.Etc.,in combination with the problems and the beneficial experience outside the territory,China ’ s fair competition review system should improve the government ’ s review capabilities and willingness through training and establishing incentive mechanisms in terms of self-review methods,and treat existing policies and incremental policies equally in terms of review objects.For exceptions,the right to set up exceptions should be limited and the content of the refined exceptions should be refined.External supervision and third-party evaluation should be done in the guarantee mechanism,and the punishment should be increased.The system basis should be legalized for the fair competition review system.
