Research On The Interpretation System Of The Inner-party Regulations

At present,the inner-party regulations system has been incorporated into the socialist legal system,and the construction and improvement of the inner-party regulations system has gradually been put on the agenda.The interpretation system of inner-party regulations is an important part of the inner-party regulations system.For a long time,insufficient attention has been paid to the construction of the interpretation system of the inner-party regulations,and there are problems such as the unclear of the interpretation subject and interpretation validity.The "Regulations on the Formulation of the Rules of the Communist Party of China" clearly stipulates the part interpretation subject and validity,which promotes the further development of the inner-party regulations system.A sound interpretation system of the inner-party regulations is conducive to the improvement of the inner-party regulations system。It can also promote the legalization of inner-party regulations,and improve the party’s ability to govern.However,the existing provisions only stipulate the subject and effectiveness of the interpretation,which is far from enough to improve the interpretation system of the inner-party regulations.Therefore,this paper takes the interpretation system of the inner-party regulations as the research object,hoping to explore the improvement path of the interpretation system through a series of analysis.This paper is divided into three parts,including the introduction,the body and the conclusion.The body part is divided into the following five chapters:Chapter one:basic theory of the inner-party regulations inter:pretation.This part mainly probes into the basic theoretical problems of the inner-party regulations interpretation.Firstly,it clarifies the meaning of the interpretation of the inner-party regulations,and analyzes the related concepts.Secondly,the paper explores the characteristics of interpretation.Thirdly,it divides the interpretation of inner-party regulations into abstract interpretation and specific explanation according to the different bases.Fourthly,the author probes into the method of interpretation.Finally,it probes the significance of inner-party regulations interpretation.Chapter two:the history of the interpretation system of inner-party regulations.The situation is divided three parts,including initial stage,exploration stage and development stage.Chapter three:situation analysis of the interpretation system of inner-party regulations.This part is divided into two parts:development status and existing problems.The first part analyzes the development status of the interpretation,and probes into the status from the perspective of the subject,object,procedure and effectiveness of the interpretation.The second part is about the problems existing in the system of interpretation,including the right the power of interpretation,the standard of interpretation and other problems.Chapter four:the suggestions for improving the interpretation system of inner-party regulations.First of all,we must clarify the power of interpretation of the party rules.Secondly,we should standardize the form of interpretation.Thirdly,the principle of the interpretation clearly defined.At the same time,improve the mechanism of interpretation.Finally,we should link the interpretation system of inner-party regulations with the system of national legal interpretation.The innovation of this paper is divided into two parts:the first part is the study of the interpretation principles;the second part is the study of the working mechanism of the interpretation.In the study of the interpretation principle,the author combines the nature of inner-party regulations,adds the requirement of political principle.In the study of the interpretation mechanism,the author combined the characteristics of the legislation mechanism and the interpretation of inner-party regulations,and put forward four working mechanisms:the submission mechanism,the consultation mechanism,the opinion mechanism and the release mechanism.Of course,it is not enough to establish a sound interpretation mechanism.The author once considered adding a supervision mechanism in the article.However,the supervision mechanism of the current legal interpretation has not been perfected,the supervision mechanism of the inner-party regulations may be difficult to construct.At the same time,if the interpretation supervision mechanism is established,it is necessary to consider a series of issues such as the relationship between the interpretation mechanism and the supervision of the inner-party regulations.Therefore,the author did not write the supervision mechanism into the article.In the future,with the development of the legal interpretation supervision mechanism and the maturity of the inner-party regulations system,I believe that the mechanism of the inner-party regulations interpretation will be more perfect.
