| Party laws and regulations(hereinafter referred to as "Party rules")are important intra party documents that govern the Communist Party of China(hereinafter referred to as "the Party").As an important basis for the Party,Party rules have a natural subordination.However,currently in China,there is relatively little research on the interpretation power of Party rules.In order to meet the requirements of the development of Party rules in the new era and new situation,this paper takes "the interpretation power of Party laws and regulations" as the argument,and studies the interpretation power of Party rules from three aspects:the interpretation subject,the interpretation procedure,and interpretation effectiveness.After sorting out the current situation of the interpretation of Party rules,it summarizes its existing problems,and then puts forward corresponding improvement suggestions,so as to provide suggestions for the systematic and standardized construction of Party rules.The interpretation power of Party rules can be defined as the power of a certain interpretive subject to explain and elaborate on the provisions of Party rules based on legal authority and procedures,in accordance with certain standards and principles.It is a general interpretive power formed through interpretation and has universal effectiveness.At present,the main body of interpretation,interpretation procedure and interpretation effect of Party rules are mainly stipulated in the Regulations of the CPC on the Formulation of Intra Party Laws and Regulations,but the provisions on the main body of interpretation of Party rules are not comprehensive and clear,and there are some missing interpretation subjects and unclear scope of authorized interpretation subjects.At the same time,the interpretation procedure of Party rules is not standardized.Even though some forms of interpretation have been stipulated in the Regulations of the CPC on the Interpretation of Intra Party Laws and Regulations,the existing forms of interpretation have not yet been unified in terms of style,document number and other issues.Furthermore,the interpretation effect is not comprehensive,making it difficult to solve practical interpretation problems.Based on the above issues,this article believes that the interpretation of Party rules should be improved from the following three aspects.Firstly,it is necessary to comprehensively and clearly define the main body of interpretation.Specifically,considering multiple factors,it is recommended to determine the "Central Committee of the Party" as the interpretive subject of the Party Constitution and guidelines.Considering the characteristics of regulations,rules,and methods,the interpretation subject of these party regulations can be authorized to relevant work departments.In addition,to address the issue of unclear specific scope of authorized entities,the authorized interpretation of central party regulations should be limited to directly affiliated institutions of the Communist Party of China and relevant government departments.In order to avoid ambiguity in interpretation documents involving multiple departments,a detailed list of departments that may be involved in the implementation process or a specialized comprehensive department can be provided for interpretation,This can make the interpretation of Party rules more comprehensive and accurate.Secondly,we should standardize the interpretation procedure of the Party rules,improve the text form of fixed interpretation forms and the application rules of improved interpretation forms,so as to promote the continuous improvement of the interpretation system of the Party rules.Finally,the interpretation effect should be improved.Although the effectiveness level of formal interpretations of Party rules has been clearly defined,the effectiveness of informal interpretations has not been clearly defined.Therefore,in addition to adhering to the effectiveness rules of formal interpretation,supplementing the effectiveness of informal explanatory documents is not only conducive to the unity of Party rules’ interpretation work,but also to the construction of Party rules’ interpretation system.At the same time,for some explanatory documents that have not been issued in the form of universal documents,all explanatory documents should be made public within the Party at least to facilitate the implementation and unity of explanatory work.The study of the interpretation power of Party laws and regulations is of great significance in the new era and background of comprehensively building a socialist modernized country and achieving the second centenary goal. |
