Research On Criminal Case Management Under The Vision Of Overall Prevention

China's police practice has neglected the “small case”.Since 2009,China's policing trend has gradually evolved from a partial focus on “big cases and important cases” to “small cases and major cases”,and strives to thoroughly carry out “criminal cases” closely related to people's daily lives.The pattern is remodeling.However,the reality is not very optimistic.Various methods of control and control,as well as the “sports-style” attacks that the police are good at,cannot completely improve this situation.There are many outstanding problems that need to be explored in practice or in theory.When we look at these difficult problems again and find that the single criminal law method or the single investigation method in reality cannot satisfy the solution of the crime problem,the "holistic prevention" theory with reference to the criminal integration trend may be a comprehensive rectification of crime phenomenon.One of the ways to try,to stand in a higher criminological perspective,combined with the overall governance theory of crime,can deal with such a dilemma.Liszt believes that punishment cannot be regarded as the only means of preventing crime,nor can it treat single social governance measures as the only means of controlling the criminal situation.It is necessary to jump out of a single "small circle" such as punishment,trying to find a more effective strategy to prevent and control crime than a single punishment deterrent.Therefore,criminal cases cannot be simply understood from the perspective of crime structure in criminal law or investigation efficiency in investigation;from the perspective of criminal governance,criminal cases exist as a crime risk;from political socialization From the point of view,the criminal case is closely related to the credibility of law enforcement,and the importance of crime management in the "criminal case" is self-evident.In the current era,the criminal case is not inferior to the investigation of the major case in the detection difficulty and the required investigation resources,so there is a bottleneck in the investigation effect.The control or prevention of criminal minor crimes not only needs to be targeted adjustment under the overall mechanism of investigation,but also needs to jump out of the single-disciplinary perspective of investigation,based on the criminological theory with a broader research perspective for overall prevention and improvement.In the first part of this article,what is the "small case" ? By clarifying the connotation and extension of the "criminal case" and so on,the research object is determined for this article.After that,what is the concept of prevention that should be applied to the “criminal case”?That is to analyze the flaws of the prevention model from the criminological research fields such as the psychology of criminals,pre-crime situations and social reactions,and demonstrate the guiding role and carrier significance of the overall prevention theory in the governance of “criminal case”,and promote the transformation of existing theories.Evaluate the existing advantages and disadvantages,innovation and reconstruction mechanism.And in this way,the research context of this article is connected.Then,what is the analysis of the "small case" ? That is to further explore the criminal causes of the "criminal case",so as to understand crime more deeply and pave the way for countermeasure research.Finally,summarize and sublimate the above questions,and analyze how this type of prevention theory is unfolded and sinks into practice.That is to say,through the one-to-one correspondence between the overall prevention theory and practice,this paper outlines the research focus and seeks solutions for the high-risk situation of “criminal case”.
