Funeral, that is,for funerals, burial of dead people, funeral procedures, different customs between regions and various ethnic groups, the North has a round side of Kongbai, the South has a long moon yellow yin money, due to different customs in different regions;Burial is not always safe when it is buried. There are ancient water burials and celestial burials.Today, there are cremation burials and ecological burials, all due to different ethnic beliefs.Generations of Yi people living in Xiaobu Wang Village,Zhongzhai Township,Liuzhi Special Zone,Liupanshui City,Guizhou Province(hereinafter referred to as Xiaobu Wang Yi),they heavy worship, heavy funeral, belief in the prophet Bimo. There is an ancient saying: "When you live in the world, you owe two debts, one for your parents 'funeral debt, and one for your children's marriage.Based on the view of legal pluralism,Professor Tianchengyou believes: "National customary law is independent of the state's laws, and it is established in people's lives based on facts and experience, based on certain social authority organizations.Compulsory.People believe in the common code of conduct." [ Tiancheng has.Doubt and Innovation-Thinking at the Edge of Law[ M]..Kunming: Yunnan Ethnic Publishing,1999.147.] Gaoqicai also pointed out: "Customary law is the sum of certain mandatory norms of behavior based on certain social authority and social organization that is independent of the state's law-making law." [ Gaoqi.Chinese Customary Law Theory(Revised Edition)[ M]..Beijing: China Legal Publishing House,2008.3.] Since customary law is independent from national law,it also means that there is a wide range of living space in the vast minority areas of our country. The Yi customary law contains a wide range of contents, and the funeral customary law is one of the core contents of the Yi customary law.It mainly includes the norms of behavior in terms of funeral methods and funeral ceremonies. Its unique funeral customary law has an important regulating function in the daily life of Xiaobu Wang villagers. The Yi people heavy funeral, the funeral system according to the distribution of different branches but different,Sichuan Liangshan,Yunnan Zhaotong area of the Yi people Xing cremation, while the Guizhou area of the majority of the Yi people Xing earth burial, this is the family migration, cultural integration caused.Although there are different types of funerals in various places, funerals are all "tied" and "tied" is also called "made".It is a process in which the Yi people follow the traditional methods of their own people and follow the guidance of the Yi prophet Bimo to carry out funerals for the deceased elderly.Although they are all "tied",the programs and concepts are very different. In the old days, they were "tied" and paid attention to the layout. When they recorded the Yi ancestors "tied up",they "hit the cows all over the mountains, hit the sheep on the slopes, and hit the pigs.Black, killing chickens like Earth cakes," Moreover, the "tying" cycle is long, the lighter ones are tens of days, and the elders have a month. This must cause great waste of resources and is not conducive to the inheritance of national spiritual culture. At present,"tying up" pays more attention to connotation. For example, the "tying up" of Xiaobu Wang and Yi people often abandons cumbersome etiquette, and pays attention to the community relationship adjustment function and inner soothing function of funeral customs.Xiaobu Wang and Yi people still carry out "tying" on the inheritance of the customary law of funerals. At the same time, there are many places where they can learn from the local Chinese funeral customs, such as using the Han Feng Shui to survey the Yin house and select the burial date.Another example is the burial method according to the burial of the Han nationality and so on.Funeral dance to dance bells, this dance for the Yi ancestors to commemorate the heroes, mourning the dance of the dead, today, although the people everywhere have inherited, but most do not dance in the funeral.Through the field investigation, the author found that xiaobu Wang Yi still plays bell dance in the funeral. The dance is lively, the music is crisp, and the atmosphere of the audience cheers. It actually reflects the concept of the funeral of the local Yi people to die.In general,Xiaobu Wang and Yi people have formed their unique funeral customs in their long-term customary law inheritance. This funeral custom has played a long-term role in guiding the local Yi people to carry out traditional activities and regulate their behavior. At the same time,it can be adapted for the local people to inherit and develop,so that the customary law can be more appropriately applied to the local people; In addition, through the bell dance of Xiaobu Wang and Yi people,it can further prove and study the funeral concept of the Yi ancestors to mourn and die. Therefore, the author believes that the funeral customary law of Xiaobu Wang Yi has the value of legal research and sociological research. The author hopes to make a comprehensive record of the funeral process of Xiaobu Wang Yi and try his best to reveal the historical background and customary law connotation of the funeral custom of Xiaobu Wang Yi.Analyzing its practical impact and significance from the perspective of legal research,Little effort was made for local funeral legislation. In addition to the introduction and conclusion, the text is divided into three parts:The first part introduces the funeral customs of the small complement king and the small complement king. This part combed out the distribution of Yi inhabitants in Guizhou province, the migration profile of xiaobu Wang and Yi nationality, and the historical origin of xiaobu Wang and Yi nationality funeral customary law. This paper mainly shows the origin of the funeral customary law and the characteristics of the funeral customary law.The second part is a case study of the funeral customs of Yi residents of Xiaobu Wang Village,Zhongzhai Township,Liuzhi Special Economic Zone,Guizhou Province, showing in detail the process of "tying up" and the funeral system of Yi residents in the area.Analyze the eight procedures and three surnames in the process of "tying up" of Xiaobu Wang and Yi people one by one.Among them, the eight procedures are to select the land and time, build a room, lift, fall a room, give animals, transfer ginseng,Bell dance, and go out;The three surnames are foreign families, younger families, and girls. At the same time, the author analyzes the place, cause and influence of borrowing and following Han funeral custom in the funeral custom of Xiaobu Wang and Yi.The third part mainly summarizes the modern transformation and significance of the funeral customary law of Xiaobu Wang and Yi.Its main manifestation is to adapt more to the needs of local residents in real life, pay more attention to the comfort of the spirit of the living, pay more attention to the adjustment of the neighborhood relations of Yi residents, and at the same time prefer modern funeral methods to facilitate the adoption of local legislative actions; These changes are of profound significance and enlightenment, mainly reflected in the local people's abandonment and inheritance of the traditional funeral customary law process,as well as the practical funeral legislation guidance function.
