A Study On The Customery Law Of Funeral Rituals In Enshi Tujia Nationality In Hubei Province

Funeral ceremony is one of the specific embodiments of the traditional Tujia culture,and part of the Tujia funeral customary law.The Tujia funeral ceremony has a long history and rich cultural heritage.Researches performed by the academic circle on Tujia funeral customary low largely focus on behavior descriptions,and there is hardly deep analysis.In addition,the past researches on funeral customary law mainly concentrate on the last stage of the whole custom,not the entire funeral custom,including the various customs at the initial funeral.Each step,detail and action on the funeral ceremony contain deep philosophy meanings and cultural significance.The concepts of life and death not only have their own direct behavior demonstration,but also have their roots in people's psychology and disposition.A nation's attitude towards life and death generally indicates the nation's cultural disposition.“Every place always has its own custom.” Even in the inner Tujia nationality,there is the regional difference in funeral custom between the North and the South.This paper analyzes the funeral customary law of Tujia nationality in Enshi,an intensively-populated region of Tujia people,not only showing reference significance to the exterior environment but the inner structure.Specifically,the funeral ceremony of Tunbao expresses its symbolic meaning with verbal signs,tool signs and their relationship,presenting the social structure and social value order of a social group,representing the values and national psychology of Tujia nationality,reflecting a nation's feeling awareness and identification awareness,and exerting important and far-reaching influences on the form of national spirit and disposition.Meanwhile,the diversified law status of the co-existence of national law and has become common nowadays.When the national values go closer to national will,national law will definitely co-exist with customary law,otherwise,the contradiction between the two will occur under the influences of national conditions and dreams,the fixed and the introduced,localization and nationalization,the regional and the universality,etc.As a multinational country,China has deeply-rooted historical inheritance and national customs,which are impacting the values orientation of the national characters and groupment.With the emergence of social internet groups nowadays and the highlight of minorities and diversified values,customary law serves as an important guarantee of maintaining group characteristics and opinions.However,in the rule-by-law process,the conflicts and reconciliation between national law and customary law are unavoidable,and how national law reasonably treats the customary law of the minorities is definitely to be an important urgent issue for China in the process of rule of law.Therefore,the purpose of this paper is to study the folk custom of the Tujia people,and to analyze the composition of the folk custom of the Tujia people's funeral,National legal law of internalization of legal awareness,and even further study of the regional legal environment.Finally,the author puts forward the author's goal and expectation on the development and prospect of the folk custom of the funeral of the Tujia people.
