Research On The Family Legal Protection Of Women's Rights In The Period Of National Government In Nanjing

During the period of Nanjing National Government(1927--1938),Chinese society was in the transition stage.With the influx of western ideas of democracy,rights,equality,and freedom,people's consciousness of rights began to awaken,and the female liberation movement also sprouted and developed.The marriage and inheritance are the most closely related to a country's society in the legal system,and also the most important part of the study of women's rights in civil law.The traditional Chinese values conflicted with the western values,which made women's rights were in face of the fierce challenge in the process of modernization of civil law.During the period of Nanjing National Government,in the judicial activity of women's right,the principle of gender equality adopted by the Supreme Court and the Judicature Department truly reflected the value demand of society and enabled women to acquire independent personality in the law and promote the development of women's rights during this period.In this period,women's identity was also changed from traditional obligation standard to the right standard,in addition to the show of women's independent legal personality.For example,in marriage,women have the right to independently conclude the engagement.In the conjugal relations,women's status gradually rises and they gain certain rights in the economy.Through the study of this period,we can find that the Nanjing National Government followed the trend of social development and the times.At present,the phenomenon of inequality betxween men and women still exists in China,especially in remote areas.Through the research on the special period of social transformation of the Nanjing National Government,this article explores how the legal status of women has changed,which is instructive to the future development of the rule of law and the protection of women's right in China.
