The marriage legislation of the Nanjing National Government,is an important step inthe process of the modernization of the chinese law process.Especially,<CivilLaw·Domestic Law of Republic of China>,which was enacted in1930by the centralgovernment in nanjing,is an actual marriage law in the modern sense,and its role in thehistory of the chinese marriage law cannot be challenged.The main purpose of this articleis through legislative background legislative origin legislative process and systemsstudy,to assess its nature and status.Main content of this article in the following areas:Chapter I is the analysis of the legislative background to<Civil Law·Domestic Law ofRepublic of China>. From late Qing dynasty to <Civil Law·Domestic Law of Republic ofChina> enacted by30years, China has undergone tremendous political, economic,ideological and cultural change,The motivations for the change is the modernization ofthe law.Chapter Ⅱi s the legislation on <Civil Law·Domestic Law of Republic of China>origins and the legislative process.This chapter first describes the end of the Qing dynastyand the early period of the Northern warlords Government of legislation on marriage andfamily links between relatives of Nanjing national Government and legislative.Second onthe family’s bill drafting, formulation and style on the structure they are described.Chapter III analysed <Civil Law·Domestic Law of Republic of China> the mainsystem. This chapter from the relatives of the most representative in the legal system onmarriage and family system, the system of marriage, divorce and marital property systemof the four aspects of a theoretical research and analysis.Fourth chapter was on <Civil Law·Domestic Law of Republic of China> in thetransplant process and China’s national conditions, contradictions and conflicts in socialcustoms, as well as legal transplants in enlightenment and significance of perfecting thecurrent marriage legislation.
