Agriculture is the foundation of the national economy.China is a large agricultural country.China has a vast region,complex and diverse natural conditions and frequent natural disasters.This has brought many risks to agricultural production,and agricultural insurance has emerged as the times require.Because of the particularity of agricultural development and the high generality of possible risks,our country mainly implements policy agricultural insurance nowadays.However,there are still many shortcomings in the process of its development,such as the problems of compensation for damage after the occurrence of agricultural risks and the problems and shortcomings in the subsequent judicial procedures.On the one hand,it is because agriculture is the first industry and the modernization level of agricultural production and management embodies the comprehensive national strength of a country.Since twenty-first Century,almost every year in the central central bank of China has focused on the "three rural"issues.This shows that the central government attaches importance to agriculture.However,due to the frequent occurrence of agricultural risks,especially natural risks,agricultural insurance is of vital importance to the healthy development of agriculture.On the other hand,the development of policy based agricultural insurance in China is not mature,and the relevant laws and regulations are not perfect,especially in the respect of damages.Agricultural insurance is a complex system project.With the deepening of the reform of the rural economy and the land management model,the lagging of the relevant legislation of the policy based agricultural insurance has been highlighted,which inevitably brings problems to the compensation link of the policy based agricultural insurance.Therefore,the establishment of a perfect policy based agricultural insurance damage compensation system and problem solving mechanism has become an increasingly urgent and unavoidable problem.The article mainly analyzes the compensation for damage caused by policy agricultural insurance from the aspects of insurers,policyholders and the government.In order to clarify the current situation of the development of policy based agricultural insurance in China,clarify the current situation of development and the status of the legal system,and combine with the development status,put forward the prevention and regulation ideas for the most typical risks at the legal level.
