The Internet has brought great changes to people’s daily living conditions,and therefore it has developed more rapidly.Using the Internet to buy food,ordering food online has become an indispensable part of modern life.At the same time,the consumer brings great convenience to the network food trade,and also causes more food safety hazard.In order to make the network food trade more standard and benign development,in our country on October 1,2015,our country enacted the New Food Safety Law,"Third-party platform provider for network food transactions" this idea,in this new law first formally put forward,give its special legal subject status,in addition,it is clear that that third-party platform of the network food transaction should bear the responsibility Legal liabilities and legal obligations.It provides strong legal support for the development of online food trade.The article analyzes and discusses the legal concept,legal status,legal liability and legal obligation of the third-party platform of the network food trade from the angle of the standard In 2005,a new chapter of the "Company Law" was opened.The company’s corporate personality denial system was formally confirmedanalysis and the sociology of law.It is emphasized that the obligations of the third-party platform provider of the network and the corresponding legal liabilities after the breach of the obligation are clarified on the basis of the provisions of the Food Safety Law,Article 62 and Article 130 as the basis for the elaboration and inquiry.Through the lack of the current legislation and the present theoretical circle,In order to improve the legal liability of the third-party platform of online food trading.First of all,this paper introduces the business model of online food trading,the concept and characteristics of the third-party platform of online food trading,the source and type of legal liability,In this paper,domestic scholars’ different views on the legal status of the third-party platform of online food trading are sorted out and commented,and the author also expresses his own views.Secondly,this paper discusses the current situation and problems of the legal liability of the third-party platform of the online food trade by using the method of sociology of law.According to the provisions of current laws and regulations on its legal liability,the author clarifies the legal obligations and contractual obligations of the third-party platformfor online food transactions,and clarifies the legal responsibilities of the third-party platform.Internet technology With the rapid development,in order to make the third-party platform develop better,in the third chapter,the author analyzes and studies the current situation of the daily supervision of the network operation platform,and finally puts forward the scheme design of perfecting the supervision.Finally,the concept of "social co-governance" is put forward,and combining with the current law provisions on third-party food trading platform,legal responsibility,the existing problems are summed up,and the causes of the problems are reconsidered.Put forward the opinions and suggestions to perfect the legal liability of the third-party platform of online food trading.
