Study On The System Of "Separation Of Three Rights" Of Agricultural Land Under The Background Of Rural Vitalization Strategy

As an important institutional innovation,the agricultural land "separation of three rights" has attracted much attention since it was proposed.The 19th National Congress of the Communist Party of China proposed rural vitalization strategy.The Party's 19th National Congress on the rural revitalization strategy clearly proposed to improve the "separation of three rights " approach.In 2018,China proposed the five-year plan for the Rural Revitalization Strategic Plan(2018-2022),which clearly stated that it is necessary to improve the "separation of three rights "system for rural contracted land.It is also an echo of the"separation of three rights "of agricultural land.The "separation of three rights " of agricultural land is considered by the official and scholars to be another major institutional innovation equal to the household contract responsibility system.From the perspective of the agricultural land,it has the largest spatial extent in rural areas.It is not only related to the Chinese problem of feeding the population,but also related to the Chinese people's ecological security,and more related to the coordinated development of China's urban and rural integration.The land system is not only an economic property rights system,but also its changes have profoundly affected the political,social and cultural aspects of the countryside.So the institutional design of the "separation of three rights "of agricultural land is of great significance to the rural revitalization.And this paper focuses on analyzing,comparing and discussing the connotational traits,historical background and actual needs of agricultural land"separation of three rights" and the relationship with the rural revitalization strategy.First of all,this paper systematically sorts out the historical logic from "separation of two rights "to "separation of three rights" in agricultural land.It is mainly concentrated on three points.The first is to review and sort out the history of the nature of the land from the peasant ownership to the collective ownership of the peasants.The second is to sort out the institutional changes in the separation of agricultural land from "separation of two rights "to "separation of three rights ".The third is to systematically sort out the historical changes in China's agricultural land system.In these three processes,the practical necessity of"separation of three rights " of agricultural land is displayed.Secondly,this paper deeply analyzes the actual problems and contradictions of collective ownership,farmer's contracting rights and farmland management rights in the " separation of three rights "of agricultural land.Especially for the ambiguity of collective ownership,the stability of farmers' contracting rights and the lack of vitality of farmland management rights have been explored.In addition,the discovery of the contradiction between collective ownership of land and contracting rights,contracting rights and management rights will also affect the "separation of three rights" system of agricultural land.Finally,this paper cracks down on the practical problems of collective ownership of farmland "separation of three rights ",farmer contracting rights and farmland management rights.By insisting that the property ownership of the land does not change,the contracting rights of farmers and the rights and interests of contractors are stabilized,and the vitality of land management rights is maximized.By rationalizing and resolving the internal relations and contradictions of the "separation of three rights",we will release the vitality of the countryside and develop modern agriculture,thus promoting the rural revitalization of our country.
