Study On The Way Of Judicial Relief Under The Background Of Judicial Reform

The fundamental purpose of the national judicial relief system is to protect the legal rights and interests of the vulnerable groups involved in the litigation.However,China's judicial relief system started relatively late.At present,there are still many limitations and unworkable in both theory and practice.In the successive judicial reform,the concept of safeguarding human rights and putting people first has gradually become popular,and more and more scholars have begun to pay attention to and study judicial relief,but few people have paid attention to judicial relief methods.Researches on judicial relief methods are scattered in various literatures on judicial relief system.However,the author believes that this problem is the essence of the legal aid.The author studies various documents related to judicial rescue and typical national judicial rescue system,and analyzes three elements of judicial rescue mode,that is,relief object,form and method.Facing the social contradictions,criminal crime in our country,the serious situation of our country currently lag of legal aid has been unable to meet the timely settle disputes,helping disadvantaged groups out,promote social harmony and stability,not only affects the function of judicial relief system in the human rights relief on the play,in the long run,will hinder the process of the construction of the rule of law in our country.This paper adopts the method of research,investigation and comparison,takes judicial reform as the background,summarizes and clarifies the development and change process of the three elements of China's judicial relief mode,and analyzes various problems and defects existing in China's judicial relief mode with cases,and puts forward targeted Suggestions.
