The Internet is a "double-edged sword",which brings convenience to people,accompanied by a series of negative effects,and telecommunication network fraud is one of them.It is a new type of crime that distinguishes traditional fraud crimes.It mainly uses communication networks and the Internet to conduct fraudulent use of non-specific objects in a non-contact manner.It presents the characteristics of “intelligence,specialization,grouping,transnationalization”,which has caused tremendous impact on China's traditional criminal legislation,judicial and criminal law concepts,making it unable to adapt to fraudulent crimes after alienation.In recent years,the crime rate of telecommunication network fraud has been increasing year by year,and the means of fraud has been continuously refurbished,which has doubled the number of victims and property losses.It can be said that the current high rate of telecommunication network fraud crimes,large coverage and high losses have become the "business card" of the crime,and it has become a wide-ranging social problem,especially the occurrence of many telecommunication network fraud cases.The incident of casualties has aroused widespread concern in society.Although the judiciary has always adhered to the policy of severely stimulating telecommunication network fraud crimes,these criminals are constantly performing the trick of "one foot high,one high demon".Therefore,in order to adapt to the needs of punishing new crimes in the Internet age,the author intends to explore the causes of the current high incidence of telecommunications network fraud crimes and governance dilemmas,and propose corresponding countermeasures in light of the existing legal provisions,hoping to find effective combat and prevention of telecommunication network fraud crimes.Methods.This paper first explains the general situation of telecommunication network fraud crime,including the causes,characteristics and manifestations of the crime.Secondly,it clarifies the legislative status of telecommunication network fraud,which includes the legislative status quo of telecommunication network fraud in China and the legislative status quo of the country's crimes.It forms a sharp contrast,and then analyzes the current legislative loopholes in order to perfect the criminal law system..From the practical point of view,it discusses the challenges brought by telecommunication network fraud to China's criminal law,including: there are conflicts of jurisdiction in the face of telecommunication network fraud,the amount is difficult to determine,the evidence is extremely difficult and other factors,through the analysis of the above situation to help practice The community provides a path for managing telecommunications network fraud.Finally,the author proposes prevention and control measures against the damage caused by the crime to the public and social order,making it more systematic and standardized,and hopes to provide theoretical support and practical inquiry.
