Research On Prospect Interest Compensation After Rescission Of Commercial Commission Contract

The article is based on Contract Law of the People's Republic of China,relevant judicial interpretations and juridical practice,taking commercial commission contracts as the research object.Research and discuss the prospect interest compensation.The article combines the focus of cases,tries to note and summarized commercial commission,and analysis expression of prospect interest compensation,necessity of compensation,the certified standard of prospect interest.The article explains my opinion.I hope my conclusion can solve the question which is mentioned.Apart from introduction and ending,the article contains four parts.Part one contains judgments of prospect interest compensation in commercial commission contracts,and explains the reason of compensating or not.Part one also contains three viewpoints in the theory.Practical problems of prospect interest compensation in commercial commission are analyzed in part two.Firstly,some common problems in reality are put forward.And all forms of prospect interest are summarized.Secondly,discuss rules and calculation methods of prospect interest.Thirdly,explain situations of reducing compensation.In order to define the reasonable range of prospect interest compensation.The necessity of prospect interest compensation is researched in part three.Specifically,discussion about the necessity of prospect interest is divided into four aspects:particularity of commercial commission contract,litigant's fault,relation between interest compensation and dissolution of the commission contract,views of law and economics.Part four contains suggestions of prospect interest compensation in the commercial commission.Proofs and responsibility are analyzed,and then put forward suggestions of adjudgement.
