One of an important part of china's judicial system is forensic appraisal system?It is an important foundation of legal justices,it can complete china's judicial system.Today's society is developing very fast,the Contradictions and disputes that exist in social activity become more and more complexity and diversity,Forensic Appraisal is an important measure of solve Contradictions and disputes,it can help formed a rational,fair,scientific litigation environment.The forensic appraisal access system is the first step of the management system of forensic appraisal,it is significant to build the judicial forensic institutions system and a contingent of judicial forensic staff.After the promulgation and implementation of the 2005 Decision on the Administration of Forensic Appraisal by the Standing Committee of the National People's Congress(hereinafter referred to as the decision),the forensic appraisal industry is developing fast,in the meanwhile,many problems have arisen.In the field of forensic appraisal access,a lot of small-scale,unreasonable layout,low-level judicial forensic institutions are established caused by the low access threshold and the qualification checks of judicial administrative authorities is not strict enough.A lot of judicial forensic staff's legal qualities and professional ethics are low,and their professional skills level is irregular.This phenomenon blocked the guarantee of judicial justice and hampered the increase of judicial efficiency seriously,and damages the good image of the forensic appraisal industry.Now,the reform of forensic science system is in progress,the judiciary require a strict access of forensic appraisal by rigid control over the business scope of forensic appraisal and the access conditions of forensic appraisal and the access procedure of forensic appraisal to promote the over-all level of forensic appraisal industry and improve the quality of Forensic Conclusions in order to ensure the judicial justice.In this background and on the basis of summarizing china's Forensic appraisal access system analyse the problems of strict forensic appraisal access and put suggestion to solve the problems.This thesis is divided into four section to discuss.Part one introduces china's forensic appraisal access system.This paper take the time of promulgation of the decision as the dividing line,introduced and commented the basic situation of china's forensic appraisal access system,including the business scope of forensic appraisal and the access conditions of forensic appraisal and theaccess procedure of forensic appraisal,the existing problems are pointed out,provides the foundation for analysis china's strict forensic appraisal access system after document.The second part introduces strict forensic appraisal access system.Firstly,the necessity of strict forensic appraisal access is analyzed in context.Secondly,introduced the content of strict forensic appraisal access,including strict the business scope of forensic appraisal and tighten access conditions of forensic appraisal and strict the access procedure of forensic appraisal.The third part introduces the operation difficulties of strict forensic appraisal access system.This part mostly analysis the problems in the work of strict forensic appraisal access at this stage.Especially if the business of judicial appraisal which beyond FOUR BROAD TYPES should be brought into the registration and management scope of the powers of judicial administrative authorities.Analysis and demonstration the establishment status of judicial forensic institutions and the incompleteness law and regulations of forensic appraisal access system,laid the foundation for putting forward measures in later chapters.The fourth part introduces the breakthrough methods of the operation difficulties of strict forensic appraisal access system.This part discusses the problems of the operation difficulties of strict forensic appraisal access system and the corresponding measures were given from four aspects to achieve the goal of improve and perfect forensic appraisal access system.The first one is perfect the law.The second one is the reasonable layout of judicial forensic institutions.The third one is making a good development planing of the business of judicial appraisal which beyond FOUR BROAD TYPES.The fourth one is qualification confirmation and laboratory accreditation of judicial forensic institutions.
