The non-police function of police refers to the active or passive participation of the main body of the police in non-police duty activities outside the scope of statutory duties.In fact,it is a non-police use of the police force.Under the background of complex and drastic changes,public security organs should not only maintain public order,but also solve the difficulties of people's daily life.They should implement both laws and policies.The trend of normalization of non-police functions is obvious.Police organs are increasingly becoming "omnipotent" administrative organs.Today,the rule of law has become the basic way of governing a country.How can police organs integrate "stressing politics" with "stressing the rule of law" more effectively? It is of great social value to think about the standardization of police functions with the thinking of rule of law.From the current situation of the development of non-police functions of police,on the one hand,the legal system is insufficient.The legalization of non-police functions is low,the scope of non-police functions and the procedures for their implementation are not clearly defined,and the legal basis is weak.On the other hand,due to the inadequate "centralized mediation" of government functional departments and the inadequacy of social service construction,leading to the poor mediation of social contradictions,public security organs eventually become the "export" of social dispute resolution.At present,our country is in the deep water area of reform and opening up.Social contradictions are complex and diverse.In practical work,public security organs mediate a large number of contradictions and disputes beyond the scope of police functions and pay huge administrative costs.The study of non-police functions is a positive response to the need for the public security organs to perform their functions under the rule of law.It will also play an important role in the modernization of grass-roots governance capacity and governance system in China.The full text is divided into five parts:The first part is the origin of the writing of this article,that is,the raising of the problem.This paper mainly introduces the current situation of non-police functions.Non-police functions are the adjustment to the great reform and opening-up,and a series of problems arise from the performance of non-police functions.The research on non-police functions should be paid attention to.The second part is the theoretical analysis of non-police functions.To study a problem,we must first have a clear understanding of the problem itself,that is,what the problem is.This part includes the elaboration of the concept of non-police functions and the discrimination of similar concepts which are easy to be confused with non-police functions of public security organs in practice,which is helpful for a clear understanding of the true face of non-police functions.The third part is the historical evolution of non-police functions.This paper introduces the historical development of non-police functions in the world.The purpose is to find out the root causes of non-police functions by comparing the common characteristics and differences of the development of non-police functions between China and foreign countries,and to draw lessons from the response measures of various countries in order to find useful experiences and lessons for our country.The fourth part mainly analyses the causes of non-police function problems in China.The study of non-police functions is a comprehensive and systematic problem.Therefore,this paper analyses the causes of non-police function problems from various aspects and tries to locate the source of the problems accurately.The fifth part is the countermeasures and suggestions for non-police functions.On the basis of combing and analyzing the previous article,combining with the police practice,and taking the public security system as the demarcation point,this paper puts forward some countermeasures and suggestions to optimize the performance of public security functions and enhance the degree of rule of law in police operation,aiming at the external and internal causes of non-police functions.
