Research On The Power List Path Of The Legalization Of Police Power In Our Country

In the process of accelerating our country's legalization,the reform of public security work has been constantly deepened.While the construction of public security legalization in our country continues to make progress,there are some gaps to be filled;the security public also faces many challenges and opportunities.The legalization of police power is the basis and precondition of establishing the legalization of China.Police power is an important dependence for the state to run our country by law.The legalization of police power refers to the demarcation of police power by law and developing a complete police power inventory system to guarantee and restrain the operation of police power in the governance space of law.This paper explores the realization path of police power legalization from the perspective of police power list,and tries to constructs a feasible framework for the harmony of police power and citizenship.The police power list is divided into three parts,namely positive lists,responsibility lists and negative lists.The positive list is based on the principle of "things without authorization of law are prohibited",and explicit the boundary of the police power to identify what the police can do.The responsibility list is based on the principle of "statutory responsibility must be done",and clarifying that statutory duty of the police must be done and cannot be taken off for any reason.The negative list is based on the principle that "statutory prohibition should not offender",and it is clear that the police power must not exercise the act that is not granted by law;otherwise it is considered illegal and must be punished according to the law.In this paper,the author will examine the accurate direction of the people's police law revision from the perspective of empirical analysis,and use the "people's police law of the People's Republic of China(hereinafter referred to as the people's police law)as a mainly relying for the list of the police power.This paper expounds on the macroscopic structure,explicitness and feasibility of the law of the people's police for the process of police power reality.It provides a theoretical basis for police law enforcement,so as to promote the construction of police legalization,and build a solid foundation for the implementation of the legalization in China.
