Research On Promote Legal System Of China’s Outward Foreign Direct Investment Under "The Belt And Road"

In recent years,the world economy is slowly recovering.With this opportunity,foreign investment has ushered in new challenges.Under the influence of international politics,security and trade protectionism,the emergence of new growth points has gradually improved the political environment.However,the global economic growth is lower than expected,and investment uncertainty in the international market remains high.In this context,China has put forward the "the Belt and Road’’ strategy,vigorously develop foreign direct investment(FDI),and use investment to stimulate economic growth.There are two aspects about the value of the study of China’s FDI promotion legal system under the "the Belt and Road".First,FDI plays an important role in promoting the "the Belt and Road" strategic development process and requires legal protection;second,China’s current investment promotion legal system is not perfect.Problems are found in the process of analysis,and lessons are learned from experiences of other countries to improve China’s investment promotion legal system.At present,most scholars in China are discussing from the perspective of risk prevention.Little is known about how to improve and promote the legal systern and promote the development of foreign direct investment.This article proceeds from this perspective,analyzes the attitude of countries along the "the Belt and Road" approach to Chinese investment,and draws lessons from the legal systems of the world’s major foreign investment countries.Finally,it analyzes the problems existing in the development of foreign direct investment under the "the Belt and Road" initiative from three aspects:tax incentives,financial support,and information service technical assistance.There are tax incentives for tax concessions that have not yet been acknowledged,"no separation of countries and points" credit controls are still limited,and the lack of a system of letting down inhibits the enthusiasm of enterprises for foreign investment and the anti-tax avoidance regulations are not conducive to companies reinvesting their external income,etc.;There are still problems in financial support such as incomplete financial investment,unreasonable application and approval systems,and lack of industry-oriented support for financial services;there are problems with information services such as duplication of information resources,lack of technical assistance,and insufficient information promotion.This article analyzes these issues and proposes corresponding solutions.In order to smoothly promote the "the Belt and Road" and ensure the long-term and stable development of the "the Belt and Road",the construction of the legal system is of utmost importance.This should be the consensus of China and the countries along the route.
