Functional Regression And Institutional Reconstruction Of Business Registration

The unique function of the business registration system has played a great role in the development of the market economy in China.The business registration system is not only a legal way for the commercial subjects to prove their legal status but also an effective way for the state to supervise the commercial subjects and protect the safety of commercial transactions.The current business registration system adopts the decentralized legislative model and puts the business registration under the management of public power.And it played an active role over a period of time.However,the single management function has exposed many problems in practice with the rapid development of social economy.Based on analyzing and referencing foreign research,this paper adopts the analytical research method,historical comparative research method and value research method to explore the related problems of the business registration system.According to the national conditions of our country,we can study and absorb the excellent experience of foreign countries.The research mainly includes four parts: Firstly,this paper introduces the general theory of business registration,expounds the connotation of business registration,the legal characteristics,and the type analysis of business registration,which lays a theoretical foundation for the later research;Secondly,it discusses the types,origin,development and functional changes of the basic functions of business registration.Based on time,this part combs the function of the business registration system in each period,explores the transition of the function of the business registration system in the historical development,and paves the way for the return of the business registration function of our country.Next,this paper rethinks the basic function of business registration in our country combined with the actual case,including the present situation,reason,and method to solve problems in our country.Finally,through the discussion of the above contents,this paper puts forward the method and route to reconstruct the business registration system of our country.The most important thing is re-interpreting and positioning the function of business registration.It is necessary to realize the transformation from management function to service and incentive function.Therefore,a complete business registration system is established.It is very easy to use the administrative management mode when the administrative organ carries on the business registration,which leads to an insurmountable gap between the practice and theory of the business registration system.In order to adapt the function of the business registration system to the development of social economy,this paper tries to explore the effective ways of linking the theory and practice of business registration by analyzing and exploring the function of business registration in China.It is expected that the theoretical research will benefit the reform of business registration system in practice.And the business registration system will play a more important role in commercial transactions and provide more powerful protection for the healthy,safe and orderly development of the market.
