In recent years,China's Internet industry has been in a rapid development stage.The traditional physical sales mode has also begun to accelerate the transformation to the Internet sales mode.The new marketing mode has led to the transfer of mass consumption places from physical stores to mobile Internet.Most consumers participate in the "carnival" of Internet consumption.It can be said that e-commerce derived from the Internet has been everywhere,and its number and scale are increasing day by day.In the whole framework of e-commerce,third-party payment as an important part of e-commerce,its importance is self-evident,should also occupy a pivotal position.With the increasing number of Internet consumers,the scale of e-commerce continues to expand,leading to the rapid growth of third-party payment industry.Daily payments through third-party payment platforms are also normal.In the process of the operation of e-commerce payment platform,new problems inevitably arise,and its solution methods can not be effectively solved in accordance with existing legal norms and systems.This paper analyses and defines the definition and characteristics of the third-party payment platform in detail,aiming at clarifying the main legal relationship between the third-party payment platform and other subjects in practice.By observing the current situation of the third-party payment platform on the Internet in China,the main legal problems that have not been effectively solved by the third-party payment platform are found and sorted out.By comparing the advanced experiences and practices of the United States and the European Union in regulating and resolving the legal problems of e-commerce payment platforms,combining with the actual legislation situation and the current normative system of China's third-party payment platforms on the Internet,this paper puts forward some reasonable suggestions for the development of China's third-party payment platforms industry,aiming to solve the problems,remedy the loopholes and effectively protect the legitimate rights of online consumer's benefit.In order to standardize and guide the third-party payment industry in China,so that it can develop and operate benignly and orderly under a sound and complete system.
