Research On China's Circuit Trial System

Circuit trial system is key to the judicial reform,which is aimed at serving the people,reducing the cost of client,balancing the fairness and efficiency.Circuit trail system has been proved effective for resolving disputes and safeguarding the order.On the other hand,the knowledge of law in public is increased with circuit trial system,which is core to the great project of management of the country according to law.The supreme people's circuit court has been established with the aim to enrich and develop the circuit trial system.The project of ruling country according to law is advanced with the supreme people's circuit court,which is the new stage of the development of the system.The circuit trail system has been attracted enormous attention by the whole society,which presents significant opportunity for the improvement of the system.In this thesis,the legalization and practice of the circuit trail system is studied based on the China's current conditions.Several advices to improve the system is proposed,which could be of value to satisfy the increasing legal need of the people,and to advancement of the legal reform.The thesis is with three parts:First,open the topic,Chapter II,an overview of the circuit trail system is provided in the first part.By expounding the connotation and characteristics of the circuit trial system,it explores its role and significance,and analyzes the value of the circuit trial system,which lays a theoretical foundation for this study.Secondly,on the basis of the first part,the second part reviews the history of the circuit trial system,sorts out the design of the circuit trial system in China,and analyzes the practical dilemmas faced by the circuit trial system in China.Specifically,Chapter III,the historical review of the circuit trial system.This thesis briefly describes the development process of the domestic and international circuit trial system.On this basis,it compares and analyzes the domestic and international circuit trial system,and then explores the lessons to could be learned.Chapter IV,the dilemma faced by China's circuit trial system.On the basis of sorting out the lack of relevant legislation in our country,the problem in the practice of the system is studied,and several suggestions are proposed.Finally,in the third part,through the theoretical analysis of the first part and the secondpart on the basis of system history,system design and practice dilemma of circuit trail,the thesis puts forward suggestions for perfecting the circuit trial system in China.Chapter V the advice for the improvement of circuit trail system.Based on the parts mentioned before,we have made a proactive reflection on the better improvement of the circuit trial system in China,and clearly proposed to supplement the legislative system of the circuit system,strengthen the standardization of the basic circuit trial system,and optimize the specific operation of the supreme circuit trail court.Establishing the supervision mechanism of jurisdiction,and improving the related rules.So we will enable the circuit trial system in China to better promote judicial notarization and serve the people.
