Research On The Protection Of The Right To Privacy In The Internet Age

In the era of information network,the wide application of network information dissemination technology has brought various conveniences to people's study,work and life,but also triggered a lot of privacy risks and threats.The main reason is that the network itself has the characteristics of openness,interactivity,rapidity and universality,which makes the infringement of network privacy easier,faster and more secret than under the traditional environment.This has no doubt greatly increased the protection of the right to privacy of citizens in the face of practical difficulties.In addition,the enhancement of people's desire for invasion of privacy and the contradiction and conflict between personal privacy and public interest in the network environment make the existing protection means in our country unable to cope with the privacy crisis in the Internet Age.Therefore,although the protection of the right to privacy is not a new topic,at a time when the right to privacy on the Internet is in danger,it is necessary to explore how to balance the conflict between the development of the Internet and the protection of the right to privacy of individuals.Therefore,it is of great significance to perfect the existing privacy protection measures and establish a legal system of privacy protection in line with China's future development pattern.The full text includes the introduction and the conclusion altogether six parts.The first part,firstly,through the individual case leads to the right to network privacy issues to be studied;secondly,by sorting out the literature,this paper explores the shortcomings in the protection of the right to privacy;finally,it introduces the main research methods and innovations of this topic.All these are to prepare for the research on the protection of privacy in the Internet Age.The second part discusses the definition of the right to privacy and the current situation of privacy protection in the Internet Age.Through the study of the emergence and development of the concept of the right to privacy and the extension of the connotation of the right to privacy in the Internet Age,we find that the right of network privacy is different from the traditional right of privacy;by analyzing the current situation of the protection of citizens' privacy in legislation and judicature,this paper explores the existing problems in the protection of the right to privacy in the Internet Age.All these are laying a foundation for the research of privacy protection in the Internet Age.The third part discusses the necessity of perfecting the protection of the right to privacy in the Internet Age.Whether it is the inherent pursuit of the establishment of the right to privacy,the lack of legislative and judicial protection of the right to network privacy,or the need of the times for the protection of network privacy,it is necessary to improve the protection of the right to privacy on the Internet.The fourth part discusses the basic principles of privacy protection in the Internet Age.The principles of reasonable expectation of privacy,restriction of use and balance of interests are the cornerstones of the Legal Protection System of privacy in the Internet Age.The fifth part elaborates how to improve the protection of the right to privacy in the Internet Age.Based on the consideration of China's basic national conditions,we should construct a complete legal protection system of privacy from the legislative and judicial levels.The sixth part is the conclusion.It is emphasized that China not only urgently needs to improve the relevant legal system for the protection of network privacy,but also should cooperate with other effective means to remove the obstacles that hinder the protection of network privacy.
