Study On Organizing,Leading And Involing In Criminal Syndicate Group

The organized crime of Triad nature has existed in our country for a long time,and they seriously erode the foundation of maintaining social harmony and stability.The organization of Triad Nature refers to the criminal groups formed by the criminal law of our country,which are composed of many people and carry out illegal and criminal activities by violence,threats and other means on many occasions through organized practice,and obtain economic,political and other interests,so as to achieve the possibility of transforming into a triad organization in a certain industry or region.It differs from other criminal groups,such as groups of evil forces and terrorist organizations.In judicial practice,the organization characteristics,economic characteristics,behavior characteristics and the identification of illegal control characteristics of triad organizations are the key points and difficulties in the process of applying this crime,and further determination is expected to be beneficial to judicial practice.This crime has a special form of crime suspension and attempted crime,and no criminal preparation form.Criminal Law provides that the organization,leadership,participation in the triad nature of the organization and other criminal acts,in accordance with the provisions of the punishable punishment.This provision is contrary to the principle of prohibition of repeated evaluation.In order to avoid repeated evaluation and effective fight against triad crimes,it is recommended that legislation amend the offence and raise its statutory sentence to the death penalty.
