Problems And Countermeasures Of Administrative Enforcement In Basic Education

With the deepening of the comprehensive rule of law,higher and higher requirements are put forward for the legalization of education.However,educational administrative law enforcement has failed to play its due role for a long time.In the actual handling of cases of educational law violation,the utilization rate of educational administrative law enforcement means is very low.The weakening,softening and absence of law enforcement side have caused extremely serious hindrance to the development of legalization of education.It is urgent to strengthen and improve the law enforcement of education administration and solve all kinds of contradictions and problems in the law enforcement of education administration at the grass-roots level.This study is based on public management theory and the theory of administrative law,based on the analysis summary of relevant theoretical research at home and abroad,using the literature research,investigation,interview method,field survey method,comparative analysis methods,such as breakthrough point in H city F area as a case,the analysis of current basic education administrative law enforcement,the problems existing in the education administration enforcement at the base of the investigation and research,and put forward countermeasures to improve the basic education administrative law enforcement.At present,China's grassroots education administrative law enforcement situation is uneven,and there are significant differences in the degree of attention to education law enforcement.Taking F district of H city as an example,for the education system,the education administrative department is used to solve the problems in its public schools through administrative orders and internal punishments,playing the role of "principal".However,private education lacks supervision for a long time.Usually,it is only carried out through annual inspection and other channels.When confronted with the requirements of investigation by the higher authorities,"sports" joint law enforcement is carried out without a long-term mechanism.For a long time,the education administrative law enforcement work in F district has basically been nothing but a sham,showing the absence of education administrative law enforcement at the grassroots level.As the superior and grass-roots government's emphasis on education administrative lawenforcement,education administrative law enforcement in recent years has obtained certain development,but many problems still exist: for in the public school system,there are basic education administrative department internal lack of specialized law enforcement agencies,the problem of improper education managers of education administration enforcement;For private educational institutions,there are problems such as unshared resources of multi-department joint law enforcement,unsmooth information communication,and ununified punishment.In addition,in the grassroots education administrative law enforcement,there are also widespread problems such as the lack of sound laws and regulations to be implemented,the insufficient ability of the education administrative law enforcement team,and the weak legal concepts of the education law enforcement objects and the masses.The analysis of the causes of the problems existing in grassroots education administrative law enforcement can be carried out according to the objects of law enforcement.For public schools,it is mainly caused by the unclear definition of the legal relationship between the government and schools and the lack of legal thinking of education managers.For private educational institutions,the lack of joint law enforcement system construction and the role of the township is not paid attention to is the main reason.The common problems between the two are mainly caused by the lack of reasonable talent selection and training mechanism,imperfect law enforcement supervision system and inadequate legal publicity and education.Based on the actual situation of F district and the experience of domestic pilot areas,this paper classifies and analyzes the existing problems and causes of grassroots education administrative law enforcement,and puts forward countermeasures and Suggestions for improving grassroots education administrative law enforcement.Second,strengthen the construction of administrative law enforcement system within the education system.The third is to strengthen the legal publicity and education for the administrators of educational administrative law enforcement.For private educational institutions,on the one hand,it is necessary to establish and improve the comprehensive education law enforcement system and set up special funds for joint education administration law enforcement.On the other hand,it is reasonable to delegate educational administrative law enforcement authority.For the existing common problems,it puts forward countermeasures and Suggestions to explore andimprove the basis of education administrative law enforcement,build a strong education law enforcement team,actively strengthen the publicity of education laws and regulations,and establish and improve the supervision system of education administrative law enforcement.It is hoped to provide some theoretical references for the smooth implementation of education administrative law enforcement in China.This paper draws three conclusions based on the combination of theory and practice at the grassroots level.First,the research results provide direct guidance and Suggestions for the education administrative law enforcement construction of H city F district government,which has certain theoretical guidance and reference value for strengthening the construction of education administrative law enforcement at the grassroots level.Second,the research of this paper provides more vivid materials for the theoretical research of educational administrative law enforcement,which is closer to the actual law enforcement reform at the grassroots level at present,and has a certain degree of innovation and extension to the previous research.Third,under the general trend of giving priority to the development of education and comprehensively governing the country by law,the reform of the education system is imperative.The education administrative law enforcement is bound to become the main form and important means for educational administrative organs to implement administrative ACTS,and the reform of education administrative law enforcement is also inevitable.Only the legislature to strengthen top-level design,perfect management system and mechanism,change management mode,law enforcement personnel to enhance the capacity of the business,attaches great importance to the leading cadres,the masses of the people to understand,multi-pronged,mix,can truly make education at the grassroots level and efficient implementation of administrative law enforcement make education in the orbit of the rule of law.However,China's education administrative law enforcement is still very imperfect,there are many factors hindering education administrative law enforcement,education administrative law enforcement construction is a long way to go.
