Study On Perfecting Criminal Legislation Of Punish Evil Forces

In January 2018,the special action of “eliminating underworld organizations and evil forces” began.The special action of “eliminating underworld organizations and evil forces”covered the whole country and experience for three years.In the first year of the special operation,the crime against underworld organizations and evil forces has achieved remarkable results,but it also exposed a series of legal issues.Moreover,there are still places where the underworld organizations and evil forces are not distinguished,and they are still generally identified,reflecting the rule of law in China's “eliminating underworld organizations and evil forces" tasks.Evil forces are very serious organized crimes and gradually become a stumbling block to China's economic,political and social order.Although some legal documents have been promulgated in recent years,new regulations have been made in terms of the concept of criminal acts,the types of criminal acts,and the punishment of criminal acts,which have strong theoretical and legislative significance.However,it cannot be denied that legislation often has a lag,and evil forces are more variable and complex.The current laws and regulations still have some shortcomings in preventing and combating evil forces.The main manifestations are as follows: it is difficult to distinguish the boundaries between underworld organization and evil forces;it is difficult to identify special criminal acts,some criminal acts lack criminal restrictions;the supporting legal measures are not complete,etc.,so it is difficult to meet the actual needs of the “eliminating underworld organizations and evil forces” action.In-depth study of evil forces crimes and their suggestions for improvement is of great significance for combating organized crime,ensuring the unity of crimes and punishments,protecting the lives and property of the people,and establishing a good socialist market economic order.Through the study of the characteristics of evil forces in judicial practice and the analysis of the causes of evil forces,it reflects some problems in the field of criminal legislation of evil forces.Based on the existing laws and regulations,combined with China's national conditions and judicial practice,the methods for improving the criminal legislation of evil forces in China include: clarifying the legal boundaries of black and evil forces;improving penalties,improving supporting legal measures,and adding criminal law charges.It is necessary to analyze the dilemma of China's application of the law of evil forces and to put forward a good strategy to punish evil forces according to actual needs.
