Under the dual pressures of the climate agreement that imposes reductions in emissions and greater trade deficits,developed countries have to find new and more concealed barriers to protect their own trade.The carbon labeling system that is conducive to the mitigation of climate warming has become the "new darling"of developed countries because of its high capital and technical requirements.The developed countries,using the current international lack of carbon label certification standards,have deliberately raised their national standards to achieve the goal of weakening the competitiveness of products of other countries,especially developing countries.In order for the carbon labeling system to continue to play its positive role in the environment and not be abused as a tool for trade protection,it is necessary to establish an internationally unified carbon labeling system to regulate the carbon labeling system of each country.As an international organization that harmonizes trade policies among countries,WTO also provides environmental exceptions in its legal system.So WTO is a good platform to discuss the establishment of a unified carbon labeling system.This article briefly introduces the basic concepts and background of carbon labeling,and provides a solid theoretical basis for the establishment of a carbon labeling system from the perspective of economics and jurisprudence.Then,using enumerated methods,we introduce the current implementation situation of several developed countries whose carbon labeling systems are relatively mature,and assess their legal nature using relevant WTO principles and rules,and finally conclude that they have a great possibility of becoming trade barriers.Then the article attempts to analyze the path to establish a unified carbon label system under the WTO framework,including basic principles,implementing agencies,and specific rules.Finally,by analyzing the positive and negative impact of the carbon labeling system on China,propose that it is necessary for China to establish the carbon labeling system.Combining with China's national conditions,from both domestic and international perspectives,article provides concrete measures for China's response to the carbon labeling system including increasing the subsidies for adding carbon labels,promoting low-carbon environmental protection concepts,and strengthening international technical cooperation.
