Study On The Dinglichkeit Utilization Of The Groundwater

In the process of rule by law in ecological field,further legal improvement are necessary for protecting groundwater and improve its efficiency of utilization.Economical and high-efficiency use is the core of its utilization.The former means full use while the latter means that groundwater's gross reserves and quality should be focused during utilization.At present,under the general situation that the total groundwater reserves in our country are stable but the water quality conditions have not been significantly improved,the current groundwater utilization and management systems have been unable to meet the requirements and principles for natural resources.As a natural resource,groundwater has the nature of "object",but its administrative mode of utilization has made it far away from the relevant private laws and regulations.On the one hand,the interests of the relevant subject cannot be protected;On the other hand,it will make the subjects negligent to protect groundwater,all of which led to the low utilization rate while rich in total amount.Therefore,if groundwater utilization is improved through the civil law,it will accord with the development at the context of legal ecology.In the dilemma,the dinglichkeit utilization system is significant to change the current situation,the dinglichkeit utilization of the groundwater is designed to get rid of excessive administrative barriers to groundwater,assist the relevant subject to gain the right to develop and use the groundwater in private law.Through the analysis on the advantage of the system,comparing with the other utilization system,it will be obvious to improve the current dinglichkeit utilization of the groundwater through two period(initial distribution and follow-up use),which separate the groundwater rights into two parts.It will helpful to regulate the problems arising in the development and utilization of groundwater in the respect of civil rights can not only make the private subject feel the existence of their own rights but also they can take the initiative way to make the conservative,efficient and high-efficiency use of groundwater.
