The workload of psychiatrists in China is in an excessive state.Physician-patient disputes in the field of mental health occur from time to time,and mental health work is still severe.The study and clarify on the duty of care for psychiatrists helps maintain the legal rights of both doctors and patients and clarify the responsibilities of psychiatrists,and promote the healthy and orderly development of mental health work in China as well as the harmonious and stable development of society.The article starts from the perspective of the special nature of the psychiatrist's duty of care in conjunction with specific relevant cases,to analyze the deficiencies in the stipulations of psychiatrist's duty of care,doctors'duty of care on patients'performance,and doctors' duty of care on third person.On this basis,it is further proposed that psychiatrists should meet the same level of general psychiatrist's duty of care,and that the psychiatric specialist hospital's duty of care in the field of psychiatric medicine should be higher than that of non-psychiatric specialist hospitals of the same level,through the establishment of compulsory medical patients.The review mechanism,expanding the scope of passive re-diagnosis,the"timeliness" in the timely inspection and evaluation shall be clarified,the psychiatrist shall improve the provisions on the patient's performance of duty of care,and the limited liability of the third person shall be written in the "Mental Health Law",etc.Through these measures to improve the duty of care for psychiatrists.
