Study On The Legal Regulation Of Selective Law Enforcement

Selective law enforcement shows the arbitrariness of the exercising of the power of law enforcers.Citizens denounce this way of law enforcement because of the unfairness of law enforcement which can not be treated equally under the same circumstances.Although selective law enforcement is a flexible means of law enforcement adopted by the state under the circumstance of limited law enforcement resources,a large number of cases show that the long-term prevalence of such law enforcement will inevitably lead to the collapse of the credibility of law enforcement,the disadvantages outweigh the advantages and do not meet the requirements of fair and standardized law enforcement.The problem of selective law enforcement is an old topic and a new theory.Theorists have done a lot of research on it from different perspectives.But in real life,it is a universal social phenomenon just like the contradiction of things,and it has been lasting for a long time.We can not eradicate it completely.Therefore,we put forward the deconstruction idea of reducing control of selective law enforcement to control and standardize selective law enforcement,minimize the emergence of selective law enforcement,and bring it into the orbit of the rule of law.Aiming at the problem of selective law enforcement,the first aspect is to clarify the concept of selective law enforcement,define it well,analyze the characteristics of selective law enforcement and the extension of different views on its legal attributes in academic circles.The second aspect is to analyze the reasons for the existence of selective law enforcement from three aspects: legal norms,power exercise and social reality,as well as the harm brought by selective law enforcement from the necessity of regulating selective law enforcement.The third aspect summarizes the current regulatory status and existing problems of selective law enforcement from the legal regulation means after the emergence of selective law enforcement problems in the theoretical circles.The fourth aspect puts forward the path of the legal regulation of selective law enforcement from three aspects: legislative regulation,judicial regulation and supervision regulation.
