Research On Online Dispute Resolution Of Cross-Border E-Commerce In China

In recent years,China's cross-border e-commerce has developed with a strong momentum.At present,there are 22 cities in the comprehensive pilot area of cross-border e-commerce,and the import and export volume of cross-border e-commerce continues to increase significantly,opening a new channel for China's foreign trade economy.The increase in transactions in cross-border e-commerce also means an increase in the number of disputes.Cross-border e-commerce disputes have their unique characteristics.Traditional dispute resolution methods can no longer well adapt to the practical needs of protecting the rights and interests of consumers in cross-border e-commerce.The establishment of online dispute resolution mechanism has become the best choice to solve consumer disputes in cross-border e-commerce.Online dispute resolution mechanism is a diversified dispute resolution mechanism that combines electronic information technology with alternative non-litigation dispute resolution mechanism.For consumers of cross-border network shopping,online dispute resolution mechanism can solve disputes efficiently and conveniently and protect their rights and interests more effectively.China has explored and practiced the online dispute resolution mechanism for many times,but no effective results have been achieved so far.Overseas research on online dispute resolution mechanism started earlier and has rich theoretical and practical experience.With the rapid development of cross-border e-commerce,overseas researchers pay more attention to this mechanism and continuously obtain new research results.Our country set up perfect cross-border e-commerce online dispute resolution mechanism,outside theory should focus on research results,draw lessons from successful experiences,make up for the deficiency of existing practice,it both from the perspective of protecting consumer rights and interests,or from the perspective of the benign development of the China's cross-border e-commerce has very important significance.From the perspective of solving cross-border network shopping disputes,this paper compared and studied traditional dispute resolution methods and online dispute resolution methods,and drew the conclusion that online dispute resolution methods are more suitable for the development of cross-border e-commerce.Select outside a mature theoretical and practical results,such as the research achievements of the U-nited Nations comrmission on international trade law,America's commission on international online dispute resolution,etc.were studied respectively,and then analyzes the cross-border e-commerce online dispute resolution mechanism in the practice of the legal dilemma facing,from the mechanism of internal and external construction corresponding operable Suggestions,aims to promote our country to establish perfect cross-border e-commerce online dispute resolution mechanism.
