The Research Of The Legal Issues In Promoting The Rural Cleaning

With the adoption of the amendment to the Constitution and the proposal of the strategy of Rural Revitalization in the No.1 document of the Central Committee in 2018,it has become a constitutional task to build a beautiful China.It is imperative to improve the quality of rural human settlements and create a clean countryside.However,influenced by the traditional urban-rural dualism,the existing laws and regulations in China mostly focus on urban clean governance,which leads to the lack of legal protection of rural cleanliness.Facing the increasing expectation of rural residents to improve the quality of rural human settlements environment,it is more urgent to promote and effectively carry out rural cleanliness work.This paper intends to make a field survey of the villages in Kunming and Yuxi,to get a more intuitive understanding of the current situation of rural cleanliness,and to explore the current situation of rural cleanliness legislation through practical phenomena,so as to review the legislation in practice and analyze the current situation of rural cleanliness legal construction.Based on the practice,this paper probes into the legal problems of rural cleanliness existing in our country,and at the same time analyses the causes of these problems.Although there are a few legislation related to rural environmental governance in China,there are some problems such as low level of legislation,weak operability,lack of special legislation and problems of local laws and regulations themselves,which also lead to problems in law enforcement and supervision,hinder the development of rural cleanliness work,weak awareness of rural residents,imperfect public participation system and lack of sufficient.Funds investment is an urgent problem to be solved.Based on the above problems,this paper will put forward effective legal countermeasures,and as far as possible from practice,to measure rural cleanliness in Yunnan Province and even the whole country,promote national unified legislation,at the same time accelerate local legislation,improve the existing rural cleanliness local laws and regulations,change legislative concepts,attach importance to the role of soft law,give full play to the role of village rules and regulations,and realize soft law.Organic combination with hard method.We should pay attention to the law enforcement problems that have arisen in the application of rural cleanliness regulations at the present stage,strengthen the law enforcement in villages and towns,and further improve the rural cleanliness law enforcement in accordance with local conditions in terms of the clarity of law enforcement subjects and their functions and powers,the improvement of law enforcement personnel's legal literacy,and the standardization of law enforcement methods,and establish and improve the long-term supervision mechanism in the later period.Strengthen the legal awareness of rural cleanliness,implement the responsibility of rural residents,improve the system of public participation,increase the propaganda of rural cleanliness and rule of law,so that rural residents can actively participate in rural cleanliness work.In addition,in order to ensure the smooth progress of rural cleanliness,it is necessary to create diversified financing channels and establish a special fund system,so as to promote the development of rural cleanliness and speed up the process of rural cleanliness and legalization,so as to achieve the goal of urban-rural integration as soon as possible.
