Research On Legal Issues Of Transnational Marriage

At present,the phenomenon of cross-border marriage of border people in border areas has become an irreversible trend,which has attracted close attention of relevant departments.Through the investigation of six Hani villages in Mengman Town,Mengla County,Sino-Laotian border area,this paper deeply understands the status quo of cross-border marriage of border people in China.From the perspective of the current situation of transnational marriage of border nationals and the construction of relevant legal system in China,this paper holds that it is of great theoretical and practical significance to pay close attention to and study the legal protection of transnational marriage of border nationals.In addition to the introduction and conclusion,this paper consists of four parts,which are as follows:The first part is an overview of transnational marriage.The second part introduces the situation of transnational marriage.This part mainly introduces some villages in Mengman Town,Mengla County,in the border area between China and Laos,as an example,the related situation of border people's cross-border marriage,such as the number of border people's cross-border marriage families,the reasons for their existence,the ways to conclude,the basic situation of the parties and their marital status,etc.The third part mainly introduces the problems and causes of transnational marriage.This paper holds that the problems existing in transnational marriage of border people include:difficulties in settling down of non-married cohabitant foreign women,insufficient protection of children's rights and interests of transnational marriage families of border people,insufficient protection of women's rights and interests,etc.The main reasons for these problems lie in:the requirements of marriage registration system and the absence of normative system of non-married cohabitation,insufficient protection of children's rights and interests by legislation,and the lack of government between Lack of communication and so on.The fourth part points out how to improve the legal protection of transnational marriage in China.Specifically,it includes the construction of the legal system of non-marital cohabitation and the improvement of the laws and regulations of transnational marriage,so as to promote the settlement of transnational marriage problems of border people.In the field of legislation,we should improve the relevant laws and regulations for the protection of children's rights and interests,establish the principle of the best interests of children,abolish the appellation of "illegitimate children" and "children born in wedlock",strengthen the management of cross-border marriage registration,and establish a consultation mechanism between countries to facilitate the signing of multilateral agreements.
