Research On The Legal Regulation Of National Civil Drones

Nowadays,science and technology grow quickly.New applications appear in large numbers.Civil drones have been used by ordinary people.However,they also bring many risks and challenges to National security,protection of personal privacy,because of its illegal flight.Technology is a double-edged sword,and civilian drones are the best example.Human society has to limit its behavior once again and set boundaries for human activities.At this stage,the supervision of civilian drones is mainly at the initial stage.The newly revised Civil Aviation Law of the People's Republic of China has authorized the State Council and the Central Military Commission to manage the civil drones.The Civil Aviation Administration of China has issued several regulatory documents as the competent departments of civil aviation,and initially established the real-name registration and drivers.Management system including qualifications and other aspects.The regulation of the new things of civil drones is particularly important as the legal regulation of ex-regulation.However,in general,there are many shortcomings in the legal regulation of civil drones,which need to be improved.This paper mainly includes the overview of civil drones,the status quo and problem analysis of civil drone legal regulation,and suggestions and conclusions for the perfection of civil drone legal regulation.Chapter 1 Introduction,Discussion on Legal Problems of civil UAV lead by introducing the civil status of UAV development and safety risks posed by.The second chapter of the basics of civilian UAV definition,classification and characteristics,etc.are introduced.The third chapter are described in detail from legislative,administrative law enforcement and judicial status of civilian UAV.The fourth chapter summarizes the current status of legislative regulation of civil aviation in the legal system is imperfect,lack of regulation,inadequate driver qualification and flight approval system Administrative Licensing problem;there is confusion in the administrative department of administrative law enforcement,unclear responsibilities and severe administrative punishment;in the judicial regulation,there are mainly negligence violations that are easily subject to criminal law punishment,administrative punishment and criminal punishment.The fifth chapter proposes perfect suggestions for improving the civil aviation law,optimizing the flight approval system for drones,improving the qualification permit for drone drivers,and enriching the administrative supervision methods for civil drones.Chapter ? do refined summary of the paper point of view.
