Study On Legal Regulation Of Online Reservation Car Vehicle Access

As an emerging industry,the network has sprung up as a result of the development of the Internet.In 2016,the ministry of transport and other seven ministries promulgated the "Temporary measures for the administration of online booking taxi Management Services"(hereinafter referred to as the "interim measures"),the online reservation car has legalized status,the online reservation car to a certain extent has been regulated,but still failed to solve public problems,such as the public's personal and property safety.Other local government regulations to refine the "interim measures" to regulate the online reservation car,the addition of many access conditions,substantially increase the difficulty of vehicles into the online reservation car industry,contrary to the "interim measures" to encourage support for the development of the online reservation car concept.Online reservation car vehicle access can eliminate non-compliant vehicles from the source to enter the online reservation car market,the current regulations will not be able to solve the problem of online reservation vehicle access,in order to improve online reservation car vehicle access system,guide,support and supervise the healthy development of the network,this paper would analyze the current situation of the vehicle access system,the existing problems,combining with the experience of foreign online vehicle access,this paper puts forward some feasible suggestions to improve the access of online vehicles.In addition to the summary and the Thanks section,this article will analyze the access of online vehicle from the following four parts:Introduction introduces the concepts of online vehicle,market access and sharing economy,clarifies the difference between the online vehicle and traditional taxis,clarifies the relationship between the theories,and lays a theoretical foundation for analyzing the current situation,existing problems and countermeasures of the legal norms for the access of vehicles to the online;The first part introduces the current situation of legal regulation ofonline reservation car vehicle access.The state establishes a loose network of online vehicle access standards and empowers local,local refinement of access standards and the addition of individual access conditions;The second part analysis on the problems of legal regulation of online reservation car vehicle access.The ministry regulations are in violation of the Administrative Licensing Act.The inadequate compliance of local legislation violates the principle of the rule of law in legislation,violates the principle of fairness and supports the concept of the development of online vehicle.At the same time,the current regulations in the vehicle access parameters,vehicle restrictions applicable rules,vehicle insurance standards and regulatory models are unreasonable;The third part introduces foreign online reservation vehicle access legal regulation experience.This paper introduces the legal legislative procedure,the establishment of lower entry threshold in the United Kingdom and Singapore,and the joint supervision of online reservation car vehicle access,which provides experience for the improvement of the access system of network vehicles in China;The fourth part proposed suggestions on perfecting the legal regulation of the access of online vehicle.Aiming at the problems existing in the access of online vehicle in the second part of the network,combined with foreign experience,in connection with the specific national conditions of our country,we can perfect the access system of online vehicle in China from the basis of standardizing the admittance of vehicle,perfecting the basic access system and innovating the mode of access supervision.
