The development of big data makes artificial intelligence technology more and more widely used,but machine learning makes the operation of artificial intelligence out of human control to a certain extent,and brings certain impacts and challenges to the existing legal system,in order to reduce The development of artificial intelligence hinders and safeguards the interests of human beings,and it is necessary to confirm the legal status of intelligent machines and the related rights and responsibilities.Since we will be in the era of weak artificial intelligence for a long time,this paper starts from the characteristics and implementation of weak artificial intelligence,discusses the possibility of giving legal personality to intelligent machines,and shows that artificial intelligence does not have legal subject status.View.At the same time,it also analyzes the wide application of weak artificial intelligence to the new situation brought by tort liability,intellectual property rights,algorithmic discrimination and personal privacy protection,and expounds the necessity and urgency of confirming the legal status of artificial intelligence.In order to prevent and solve the legal risks brought about by the development of artificial intelligence,this paper studies the relevant foreign laws and policies and the status quo of domestic legislation.Finally,in response to these four legal issues,one-to-one correspondence proposed solutions and recommendations.The existing legal system cannot adapt to the development of artificial intelligence technology to a certain extent.Therefore,the law must confirm the relevant legal relationship caused by artificial intelligence in combination with the status quo to promote the benign development of AI and the protection of human interests.
