Artificial intelligence has entered an explosive development stage since 2010.As a technology with a wide range of influences,it has begun to be applied to education,medical,transportation and other fields.As a typical intelligent entity,driverless cars promote people’s happiness in life and also give us It brings some problems,which may cause risks such as the disclosure of personal privacy,the expansion of the harm results of criminal crimes,and new forms of crime.In addition,the progress of scientific research determines that the evolution direction of artificial intelligence must be the development of special intelligence to general intelligence.The intelligence level of the agent will gradually increase,and eventually independent thinking and decision-making will be realized,and there will be a situation out of human control.Cause unpredictable consequences.Therefore,under the general trend of encouraging,supporting,and guiding the development of artificial intelligence technology,we need to always be alert to the possible risks it may cause.In recent years,various countries have developed artificial intelligence regulation from the initial principled macro regulation to the establishment of specific norms.The risk itself is uncertain,which determines that the harmful result may or may not occur,and the corresponding criminal law should deal with it.The strategy should also include two aspects.On the one hand,it aims at solving the problems of responsibility and distribution for the harm that has already occurred.On the other hand,it is the prevention of crimes that may arise through the deterrence of the law itself.Driverless cars have the characteristics of autonomy in operation and freedom from interference in the operation process.While liberating people’s hands,their dangers cannot be ignored.The performance in the criminal law is that the traditional criminal law takes human behavior as the core.With the gradual improvement of the level of industrialization,self-driving cars will have their own sense of independence.Whether their behavior can be evaluated as behaviors in the criminal law and whether they should be held accountable by themselves,whether developers and producers should be held accountable after an accident,this all remains to be seen.To solve the problem,the regulation of the criminal law should be carried out from two aspects.On the one hand,it should clarify the main body responsible for unmanned vehicle accidents,and on the other hand,it can demonstrate the legitimacy of autonomous vehicles with independent responsibility in the era of strong artificial intelligence.
