Research On Legal Problems Of Unmanned Ships

With the continuous development of science and technology at this stage,the research on unmanned ships in many countries is in full swing.However,the current maritime conventions and national laws still use traditional commercial vessels as the main target,and the emergence of unmanned vessels will pose great challenges to the current maritime conventions and national laws.This paper takes the speciality of unmanned ships as the starting point to explore the legal problems that may arise after the unmanned ships are put into operation.Based on the current maritime conventions and laws and regulations,this paper makes effective suggestions on how to improve the above problems.The first chapter summarizes the unmanned ships from the perspective of the definition,legal definition and research status of unmanned ships,studies the concept and type of unmanned ships,and defines the legal definition of unmanned ships and traditional commercial ships.The differences between the legal definitions and the current research status of unmanned ships are discussed.The second chapter analyzes the airworthiness of unmanned ships.By comparing the airworthiness of traditional commercial ships and interpreting existing maritime conventions and laws and regulations,it is studied in the context of actual cases to study unmanned ships.Whether the airworthiness standard can be met under the maritime conventions and laws and regulations.The third chapter is based on the safety problems that may be faced after the unmanned ship is officially put into use.When the unmanned ship encounters a pirate attack and the unmanned ship collides with the ship,the angle of the unmanned ship encounters the pirate.The pirate ship and piracy are redefined,and the possible results after encountering pirates are analyzed.In the collision problem of unmanned ships,combined with the current laws and regulations,the problems after the collision of the ship,such as the definition of the collision of the unmanned ship,the principle of imputation And the fault identification is analyzed to summarize the universality and particularity of the unmanned ship after collision.The fourth chapter analyzes the marine insurance problem of unmanned ships from two aspects:the obligation to inform and the coverage risk of unmanned ships.The difference between the obligation of notification in unmanned ships and the obligation to inform traditional commercial ships,Under what circumstances,the unmanned ship is subject to the implementation of the“important situation”to discuss,and analyze the insurance coverage of the marine insurance,the scope of the insurer’s responsibility and the insurer’sexclusion,and explore the current marine insurance for unmanned driving.
