With the continuous improbement of scientific level and the continuous development of market economy,the internet has a growing influence on people.Correspondingly,in the insurance industry,after the concergence of the internet and insurace,a new industry was formed---internet insurance.As the same time,a whole new mode of insurance was opend up.The popularity of internet insurance has been increasing since 2014,it has a great development potential.But as a key link in the development of internet insurance,the internet insurance contract has a series of legal problems in legislation,conclusion and implementation of contracts,and cotract supervision.These problems seriously restrict the development of internet insurance industry.Therefore,the article analyze the legal issues of internet insurance contract,in order to propose solutions to these legal issues,improve the legal system of internet insurance contract.The settlement of this problem is crucial to the development of our internet insurance and even the whole market.The article takes the internet insurance contract legal question as the research direction.Through the methods of applying theoretical knowledge of insurance,contract law,adopting comparative analysis method,literature analysis method,case analysis method and other research methods,analysis the legal issuses of internet insurace contract in China.In views of the internet insurance contract legal question,this article carries on the elaboration altogether through four parts:The introduction part of this article first briefly describes the research background of the legal issues of internet insurance contract and its practical and theoretical significance.Secondly,it makes some brief summary to the domestic and foreign literature on this issue.At last,the research content and main work of this paper are summarized.The second chapter mainly introduces the internet insurance contract.First of all,through the introduction of internert insurance to lead to the internet insurance contract concept and characteristics,thus has carried on th quite detailed analysis to the internet insurance contract special legal relationship.The third chapter analyzes the current legal problems of internet insurance contract.The question is mainly elaborated from three aspects.Firstly,there are some legislative problems in the internet insurance contract,including the lack of existing legislation and the integrity of the legal system.The second one is the problems of the road-setting and implementation of the contract,which mainly refers to the unclear standard of the establishment and effectiveness of the contract,the improper performance of the insurer's explanation obligation and the insured's informing obligation,the frequent occurrence of the problem of the insurace fraud and the lack of information security.The third is the lack of contract supercision stage.mainly refers to the single dispute resolution mechanism and thid-party platform on the weak supervison.The forth chapter mainly aims at the legal question to propose a series of proposals.From the construction of the legal system,the basic contract system to improve the supervision of the strengthening,the insurance record system of four aspects,with a view to solving the legal problems of internet insurance contracts in China to put forward feasible suggestions and countermeasures.
