With the development of the Internet insurance,the supervisor has already published several regulatory documents and carried out many special programs in China.Therefore,the Internet insurance is the key area of insurance supervision in China.Based on this background,this paper is going to talk about the legal issues of the supervision of the Internet insurance in China.There are four parts in the paper,the contents of each parts are as follow:The first part is an overview of the supervision of the Internet insurance.Firstly,this part introduces the content and characteristics of the Internet insurance,and new challenges of insurance supervision in China.Next,it introduces legislation and judicial status of the Internet insurance supervision,and puts forward legal issues of the Internet insurance supervision.According to different supervisory targets,these issues can be divided into major two parts:the legislations about Internet insurance business operated by Insurance organization are not appropriate and applications of franchised marketing principle of Non-insurance organization are not reasonable The second and third parts of the paper respectively analyze these two legal issues.The second part analyzes legal issues about supervision of the Internet insurance,which is operated by Insurance organizations.This part introduces the Internet insurance business model of the insurance organizations,the types of Internet insurance products and the ways of Internet insurance transactions.Then,this paper analyzes risks and problems in the Internet insurance business,and concludes the deficiency of legislations.The third part is about the application of the insurance franchised marketing principle of Non-insurance organizations.Network mutual aid platform and third-party network platform are not insurance organization,but they have a place in the Internet insurance business.It is uncertain whether they violate the insurance franchised marketing principle.Based on the analysis of the nature of the network mutual aid platform and the third party network platform and the nature of their business,this part argues that the network mutual aid platform does not violate the commercial insurance franchised marketing principle.It should be analyzed in detail for the third party network platform's violation to the insurance brokerage business franchised principle.Based on the first three parts,the fourth part clarifies the supervision direction and the concrete suggestions of the improvement of supervision of the Internet insurance.
