Research On The Applicable Deviation And Correction Of Corruption And Bribery

As we all known,the crime of corruption and bribery is always made as the key crackdown objection of the criminal law of our country.Whether the criminals of corruption and bribery can be felt the full weight of the law is not only related to the political stability of the country and the long-term peace of society,but also the image of the party and the government.In recent years,with the continuous advancement of the anti-corruption campaign of the government,the quantity and quality of corruption and bribery investigated by the judicial organ have been greatly improved more than the past.However,judging from the judgment of the court,the number of criminals of bribery and corruption who were sentenced to actual punishment is relatively low,and more and more criminals were put on probation and exemption.Compared with the judgment of ordinary criminal cases in the same period and similar duty crime cases in the past,the application rate of corruption and bribery is higher.This phenomenon will undermine judicial fair justice and even weaken the efforts to combat official crimes.Furthermore,it will not be compatible with the current situation of severely punishing corruption.The direct reason for the deviation of the sentence is the defects and backwardness of legislation,which leads to the rigidity of judicial practice.This circumstance is caused by various reasons,such as uncertainty over the criminal policy,the omission of inspection and supervision system,and the negative influence of traditional law culture.In view of the deviation for sentencing corruption and bribery,we should rectify through adjusting and optimizing the criminal policy,strengthening the legislative improvement and deepening the reform of sentencing,so as to achieve a fair and powerful punishment for corruption and bribery crimes.
