The booming of e-commerce has promoted the emergence and development of emerging financial intermediaries' third-party payment platforms,and has gradually been recognized and used by e-commerce consumers.The new model of third-party payment has revolutionized the way the public pays.However,this kind of new payment method based on Internet technology is convenient for the public,and the security problem cannot be ignored.The harm that it may cause cannot be underestimated.Because China's current laws and regulations on protecting consumer rights are not sound enough,and there is a significant lag in the rapid development of the Internet,it is difficult to ensure that consumer rights are strongly protected,and consumers in third-party payments are related to the law.Problems such as the right to know,privacy,and trading security have all ushered in unprecedented challenges.This paper analyzes the relevant legal systems in China and finds out the causes of the problems.It analyzes the personal information,the right to know,the security of funds,the right to claim and other issues of Chinese consumers in third-party payment,and studies the third-party payment institutions and consumption.Legal relationship between the people.Studying the legislation of the United States and the European Union on the protection of third-party payment in consumer rights,and drawing through relevant laws and regulations to find a feasible plan suitable for the national conditions,and finally from the perspective of consumer personal information protection,disclosure of payment service information,and consumption.Reasons for rationalization of funds security protection and fund recovery.The main content of this paper has the following five parts: The introduction part introduces the background of this paper,the status quo of third-party payment,and analyzes the research situation at home and abroad,and prepares for the in-depth study below.The second part describes the necessity and importance of protecting consumer rights in the field of third-party payments.It introduces the definition nature of third-party payment and the characteristics of consumers,and clearly points out the seriousness and urgency of consumer protection in this field.The third part analyzes the problems in China's legislation in this field,mainly for consumers' personal information security issues,consumers' right to know,fund security issues and fund recovery issues.The fourth part analyzes the main situation of the United States,the European Union and Australia in this field,summarizes its successful experience,taps its respective advantages,and combines its successful experience with China's reality to obtain protection of consumer rights in the third-party payment field in China.Inspiration.The fifth part puts forward specific suggestions for the improvement of the four major problems in the third part on the basis of summing up the foreign countries in the fourth part.Consumer rights protection is the central link in the healthy development of the third-party payment industry.The implementation of consumer rights protection can guarantee the long-term development of the third-party payment industry.On the one hand,China needs to maintain its international superiority in the field of third-party payment by continuously promoting institutional innovation.On the other hand,for the global development of third-party payment,China's norms and practices have certain reference value.From the perspective of jurisprudence,exploring the normative issues of third-party payment in China is not only of practical significance for realizing the sound operation of the domestic payment system,but also an inevitable requirement for the steady development of the Internet economy.
