Mobile Court And Judicial Service

Judicature,also known as"the application of law",usually refers to the activities of the state judicial organs and judicial personnel with statutory authority to handle cases according to legal procedures and laws.This is the jurist or legal person's definition of justice.But the judiciary serves more ordinary people.People's demand for judicial services will be influenced by economic,cultural,customs and other factors.Especially in regions with strong religious beliefs,people have different requirements for judicial service,which makes judicial service worth studying.The object of this paper is the vehicle-mounted mobile court in N district of Tibet.Based on the empirical research in N district of Tibet,this paper proposes that the operational mode of the vehicle-mounted mobile court in N district is to provide judicial services actively.The logic of operation is that justice serves the people.In addition to the judicial function,the vehicle-mounted mobile court in N district has formed a set of interrelated ways to prevent and resolve disputes vertically.Horizontally,Taking part in the activities of publicizing the rule of law,resolving disputes and maintaining social stability.As for the problems in the practical operation of mobile courts:unsound management mechanism,excessive mediation,and the deviance of grassroots judicial practice and theory.This paper proposes to construct the path from four aspects:shifting the focus of judicial resources to the lower level,improving the evaluation mechanism of grassroots judges,integrating good customs into local laws and regulations,and establishing the grassroots judicial service system through legislation.This paper is mainly composed of the following parts.Firstly,this paper discusses the reasons for the providing judicial services,actively,through the practical needs and the significance of judicial service offered by the vehicle-mounted mobile court in N district.Secondly,through empirical research and theoretical analysis,it is found that the operational logic of actively judicial services is that the judiciary serves the people.Finally,put forward the ways to construct judicial service from four aspects that are moving down the center of gravity,sounding the mechanism of local judges examination,taking good customs into the local laws,establishing the system of grassroots judicial service by legislation,in order to make mobile courts run better.In the construction of judicial service part,the article points out putting the good customs of local area into the local rules and regulations under the condition of not violating the laws of the state,in order to maintain the good customs in Tibet.Vehicle-mounted mobile court in N district has formed judicial system of comprehensive coverage in both portrait and landscape.It is worthy referencing by other mobile courts.There are a few empirical studies about the vehicle-mounted mobile courts.The livelihood project was launched by the higher People's Court of the Tibet Autonomous Region.This paper can help more people know about the operational mode of the mobile courts in Tibet.It can provide empirical data for scholars,and provide references to the construction of China's judicial system.
