Since the Internet entered China in 1994,the popularity of the Internet has been increasing and has had a profound impact on Chinese society.The development of Internet information technology not only greatly facilitates people's life,but also enables the Internet economy to develop rapidly and is full of unlimited potential,attracting the attention of countless operators.At present,the development of the Internet has entered the era of"Internet+"big data.The essence of competition in this era is actually the competition for consumers,The more users are attracted,the more data is acquired,and the more advantageous it will be in the economic development of the Internet era.therefore,we must pay enough attention to consumers to protect their legitimate interests.However,in order to occupy a favorable position in this emerging field to obtain greater benefits,the business mode of enterprises is more diversified.At the same time,the competition among enterprises is becoming increasingly fierce,and a variety of unfair competition behaviors occur frequently,which poses a great threat to the interests of consumers.With the development of the Internet,the unfair competition behaviors in the Internet sector that infringe on the interests of consumers will also increase day by day.If consumers are not protected as one of the market participants,it will eventually lead to the imbalance of the market and hinder the orderly development of the market.Under such a circumstance,as a country with a large number of consumers,China should also follow the trend of the times and regulate the unfair competition in the Internet field to protect consumers who are victimized by unfair competition practices in the Internet field.However,there are still many difficulties in the current legislation in China on this issue.As an important law to protect the rights and interests of consumers,the"Consumer Protection Law"is more about the provisions of consumers rights,less about how to regulate the behavior of operators,and it is difficult to provide comprehensive protection to consumers who suffer from unfair competition on the Internet.As an important law to maintain fair competition order,regulate operators'behaviors and promote the healthy development of market economy,the"Anti-Unfair Competition Law”recently revised and adopted in China clearly protects consumers'legitimate rights and interests for legislative purposes.It also complies with the trend of the times to add”Internet article"(Article 12)to regulate new types of Internet unfair competition,aiming at the purpose of protecting consumers through the regulation of the behavior of operators,but there is no specific relief way for consumers in the subsequent provisions,consumer rights protection is still very difficult.Therefore,it is particularly necessary to construct a system to protect the legal rights and interests of consumers in the anti-unfair competition law.This article mainly consists of five parts:The first part mainly introduces the relevant theories of anti-unfair competition law and consumer rights protection,clarifies the important role of anti-unfair competition law in protecting consumers and the necessity of protection.The second part mainly analyzes the characteristics,main types and infringement of consumers' relevant rights of unfair competition based on the Internet background.The third part introduces the current situation of relevant legislation in China and other relevant countries and regions,and points out the experience that can be used for reference,so as to provide relevant reference for China to construct the consumer interest protection system under the unfair competition of the Internet.The fourth part is the detailed analysis of the deficiency of the current legislation in our country.The fifth part,on the basis of the foregoing,puts forward some thoughts on the protection of consumer rights under the unfair competition of the Internet.Through these thoughts,the author hopes to effectively regulate the unfair competition behavior of the Internet and promote the protection of consumer interests.
