A Comparative Study On The Adoption System Between China And Mongolia

Mongolia's legislation on the adoption system is included in the Marriage Act.The marriage law of Mongolia has been in force since June 1,1999,and the adoption law of the People's Republic of China has been implemented since the amendment of April 1,1999.All two countries were in the last 20 th century,and two countries formulated relevant laws and regulations based on different legislative concepts and legislative experience according to different basic national conditions.Starting with the legal provisions of Mongolia and China,this paper compares the adoption system between the two countries,looks for the advanced place of the adoption law of the People's Republic of China,and constantly optimizes the short and insufficient of the adoption system in Mongolia.The thesis mainly adopts two kinds of research methods: literature Review and Comparative analysis method.First of all,the concept of adoption,the characteristics of adoption,the difference between adoption and foster care,the difference between adoption relationship and the relationship between stepparents and children,and the necessity of the existence of the adoption system can lay a good theoretical foundation for the writing of the thesis.Secondly,the paper analyzes the legislative provisions of the adoption system from the perspective of two countries respectively.Finally,through the comparative analysis of China's adoption system and Mongolia's adoption system,this paper explores the shortcomings of Mongolia's adoption system and puts forward feasible suggestions for the improvement and progress of Mongolia's adoption system.
