The problem of small property right house has a long history.Since the case of"painter village"in Songzhuang,Beijing,it has aroused widespread concern in the society.Many experts and scholars have explored the problem of small property right house from different perspectives,such as property right system,economics,social security and law.However,in the past ten years,the way out of small property right house is still an outstanding mystery.At the same time,with the continuous development of urbanization and the rising price of commercial housing,the unprecedented contradiction between the requirements of the broad masses of the people,especially the social vulnerable groups,and the imperfect social housing security system has intensified.Therefore,this paper discusses the small property rights.The legal dilemma faced by the house combs the dispute over various schemes to solve the small property right house,and finally chooses to combine the small property right house with the public rental housing to make up for the "deficiency" of the affordable housing with the"superfluous"of the small property right house.The transformation of small property right house into public rental housing is feasible in theory.The pilot scheme of using collective construction land to construct rental housing provides ideas for the transformation.The two have high similarity,and the residence right of the house has become the connection point of the transformation of the two.It is also of practical significance to convert small property rights into public rental housing.Compared with other schemes,the transformation within the existing institutional framework has the advantages of stability,and is also beneficial to the whole.The improvement of the housing security system.In the design of the transformation path,the transformation of the small property right house into the public rental house should follow three principles,that is,before the transformation,it is necessary to make it clear that the house property right should belong to the collective organization,and in the process of transformation,it is necessary to classify and deal with different types of small property right house.After transformation,we should adhere to the principle of proper compensation of the government when solving the withdrawal problem of the occupants of the small property right house.The concrete measures of transforming small property right house into public rental house include,but are not limited to:defining the main body of this transformation work,that is,who will lead the question,investigating whether the existing small property right house is suitable and classified and dealing with it;The occupants of the small property right house shall be examined and targeted.Convert or withdraw.
