The Chinese housing rental market is developing rapidly as the process of urbanization. Framing a complete housing rental legal system is an important task of the legal system. Rental housing legal system mainly adjust to the legal relationships referring to national, institutional units and individuals who rent house to others and charge rent. Sound housing rental system is the essential part of the housing rental market what can solve the housing problems of non-real estate family effectively, contributing to harmony and development of our social.The Chinese housing rental legal system including three parts: legislation of Low-rent housing, legislation of public letting housing, legislation of privately-owned housing. Low-rent housing and public letting housing are social welfare rental housing provided by commonwealth or institutions; Privately-owned house rental is the civil contract, what is adjusted by the market but also requires the appropriate intervention of state.Our current legal system of rental housing has great progress, but also need perfection. Low-rent housing legal system has some legal issues such as lower-level legislation; the legal system is imperfect; the local government's housing security functions of the vacant; there are contradictions of low-rent housing supply and demand; the procedure of the allocation of housing for rent is secret imperfect exit mechanism as well as the deficiency of connection system during the rental process; minor legal responsibility of the government, the implementation agencies of low-rent housing, as well as the applicants. Aiming at these issues, we propose to raise the ranks of legislation, and to arrange or coordinate the concerned provisions on low-rent housing of each regulation; the supply of land shall be increased and the financial sources of low-rent housing funding should be ensured; more attention should be paid to procedures of rent so as to ensure that the rental program is fair and impartial; there should be a strict legal responsibility for government, the applicants and the implementation agencies of low-rent housing. There are also issues of the legal system of public letting housing. Such as the actual coverage population is few, lacking of public letting housing institutions; the relevant procedure is imperfect; lacking of existing mechanisms and convergence mechanism. To solve these problems, we should uniform rules and regulations and establish public letting housing management agencies, even to expand the coverage of the actual security, improve the related procedures and establish existing mechanisms as well as convergence mechanism. Privately-owned house rental legal system have following problems: There are no regulations of the rent raising and housing intermediary organizations,"group rental"phenomenon is flooding. We should improve the relevant legislations to solve these new issues.
