| Nowadays,the wide popularization of the Internet not only brings convenience to people’s life,but also changes the way of some crimes.In the crime of sexual assault,current criminal actors can easily contact a large number of minors through online social software and online game BBS and other platforms to carry out sexual assault through the Internet.It can be seen that in the age of network information,the crime cost and the crime difficulty of using network sexual assault on minors have been greatly reduced compared with the traditional crime means.At the same time,the criminal actors can also break through the geographical restrictions through the network to reach more minors,and share the content of sexual assault on minors in the network,which is likely to stimulate other potential sexual perverts to commit crimes.However,the sex crime will cause some bad influence to the victims,the victim’s family and the society.Sexual assault not only brings serious physical and psychological harm to the minors,but also does harm to their healthy growth.For the families of the murdered minors,they have to bear huge treatment costs,but also bear great pressure from the outside world psychologically and spiritually.That is very likely to make the originally happy and harmonious family life disappear due to conflicts and quarrels,which is not conducive to the harmony and stability of the family and society.Therefore,a thorough prevention and control system should be put forward as soon as possible for the crime of sexual assault on minors,especially for the new type of crime of network sexual assault so as to prevent and reduce the crime of sexual assault on minors.The paper is divided into four parts.The first part is to analyze,compare and study the cases of network sexual assault of minors in the past five years,and summarize its main characteristics and crime types.By summarizing the characteristics of this kind of crime,this paper has a great guiding effect on reducing probability of occurrence of crime in the future.And the characteristics are mainly summarized from three aspects of criminal subject,victimized subject and criminal act.The second part is to analyze the formation mechanism of this kind crime.It mainly analyzes from two parts—the subjective factors of the criminal actor and the objective conditions in the society.According to the above characteristics and the formation mechanism of the crime,the third part puts forward the existing problems in the prevention and control mechanism of online sexual assault on minors which includes the deficiency of self-regulation in network(enterprise)industry,the unclear boundary between this crime and that crime in the penalty,the unified penalty standard and the light punishment strength.The fourth part puts forward specific countermeasures on the prevention and control of network sexual assault on minors against the background of information era.The first is about the prevention of such crimes.For example,to strengthen the self-regulation of network(enterprise)industry,it is necessary to strengthen the education of family responsibility and network prevention awareness,strength the sexual safety and network safety education in schools,and strengthen the moral infrastructure construction and legal publicity and education in the network society to create a healthy and safe growth environment for minors.The second aspect is about conviction and sentencing.Make a clear boundary between this crime and that crime--divide the punishment standard scientifically according to the age and number of the victim,and further refine the punishment level.Meanwhile establish a compulsory spiritual damage compensation system.The third aspect is to improve the community correction system.It includes implementing community correction rating systems and strengthening psychological treatment for sex offenders. |
